Development may allow earlier "start times" for specific construction <br /> activities (e.g., concrete foundation/floor pouring), if it can be <br /> demonstrated to the satisfaction of the Director of Community <br /> Development that the construction and construction traffic noise will <br /> not affect nearby residents. <br /> d. All construction equipment must meet Department of Motor Vehicle <br /> (DMV) noise standards and shall be equipped with muffling devices. <br /> e. Prior to construction, the applicant shall post on the site the allowable <br /> hours of construction activity. <br /> f. The property owner shall designate a noise disturbance coordinator <br /> who will be responsible for responding to complaints about noise <br /> during construction. The telephone number of the noise disturbance <br /> coordinator shall be conspicuously posted at the construction site <br /> and shall be provided to the Director of Community Development. <br /> g. Additional best management practices may be required by the <br /> Building and Safety Division and/or City Engineer. All additional best <br /> management practices shall be reviewed and approved by the <br /> Building and Safety Division and/or City Engineer, prior to <br /> implementation. <br /> 6. Nesting Bird Survey. Prior to the beginning of tree removal or mass <br /> grading, between February 15 and August 15, including grading for major <br /> infrastructure improvements, an avian nesting survey shall be conducted of <br /> all habitat within 350 feet of any grading or earthmoving activity. The survey <br /> shall be conducted by a qualified biologist, as determined by the City, and <br /> occur no more than 21 days prior to disturbance. If no active nests are <br /> found, no further action is required. <br /> If active nests for special status avian species or raptor nests are found <br /> within the construction footprint, construction activities shall be delayed <br /> within a minimum 500 foot buffer zone surrounding active raptor nests and a <br /> minimum 250 foot buffer zone surrounding nests of other special status <br /> avian species until the young have fledged. This buffer zone shall not <br /> extend beyond the Staples Ranch site. The appropriate buffer can be <br /> modified by the City in consultation with qualified biologists and the <br /> California Department of Fish and Game (CDFG). No action other than <br /> avoidance shall be taken without CDFG consultation. Completion of the <br /> nesting cycle shall be determined by a qualified ornithologist or biologist, as <br /> determined by the City. <br /> The buffer zone shall be delineated by highly visible temporary construction <br /> fencing, and no intensive disturbance (e.g., heavy equipment operation <br /> Conditions of Approval/PUD-68 <br /> Appendix Conditions 9 <br />
