Tri-Valley Water Retailers Cooperation Agreement <br />Page 8 <br /> <br /> b. The CoVWR shall consist of two designated representatives ("Representatives") <br /> <br /> from each Party. Each Party shall select its Representatives according to its own procedures; <br /> provided, that in the case of the public entity Parties, the Representatives shall be from the <br /> Parties' governing bodies; and provided further, that in the case of CWS, the Representatives <br /> shall be the District Manager or his or her designee and a person appointed by the District <br /> Manager. <br /> <br /> c. The annual CoVWR meeting shall occur no earlier than 30 days after the public <br /> <br /> release of the Annual Report, to ensure a meaningful public review of the Annual Report prior to <br /> the annual meeting. At the annual meeting the CoVWR shall accept public comment on the <br /> Annual Report. After the public con'n-nent, the CoVWR shall then vote to reject, approve, or <br /> approve with modifications the Annual Report. The CoVYVR may take such action on the <br /> Annual Report, and may set priorities and provide additional direction regarding the issues to be <br /> addressed under this Agreement, upon a vote of the majority of the CoVWR, provided that at <br /> least one representative from each Party votes in favor of the action. For purposes of the Ralph <br /> M. Brown Act and any other legally required public meeting procedures, the CoVWR shall <br /> constitute a joint subcommittee of each of the public Parties, and each Party is responsible for <br /> complying with applicable legal requirements regarding publicly noticed meetings. <br /> <br />8. ADMINISTRATION <br /> <br /> a. The Parties agree to fund the reasonable expenses necessary to carry out this <br /> <br />Agreement, including administrative, engineering, consulting, legal, and other costs. <br /> <br /> b. All expenses incurred for implementation of this Agreement, not otherwise <br /> <br />funded through other sources of funding, shall be apportioned equally as between the Parties.
