Mitigated/ <br />Resolved <br />Applicant Compromise / Resolution / Rebuttal <br />Resolution: Val Vista is currently a neighborhood of two story <br />homes. A move, out of the neighborhood, would require the <br />applicants to uproot their kids from their school and <br />neighborhood friends and would be more costly, overall, than <br />remodeling. The applicants (and the appellants) bought their <br />homes with the knowledge (CCBR's) that their home could grow <br />with their family. The applicant's want the same rights that the <br />Persin's (appellants) had when they remodeled their home to <br />make it the largest in the Val Vista community. <br />Mitigation: The proposed second floor has been designed so <br />that it is closer to the front of the home (further away from the <br />rear neighbors). The only bedroom window that will face the <br />Hoehne's backyard is more than 40 ft distance from the property <br />line and more than 60 ft distance from the backyard patio. When <br />you examine the drawings, you will see that the current first floor <br />roofline blocks any view into the Hoehne's backyard. Wth these <br />distances and the fact that the roof line impedes any downward <br />vision the into their yard the line of site is limited into their <br />backyard. In addition the applicants have agreed to reduce the <br />size of the bedroom window, reduce the size of the two <br />bathroom windows, raise both bathroom windows above view, <br />and to plant landscaping to maintain each parties privacy. In <br />addition the applicant's will continue to respect both audio and <br />visual privacy, as they have for twelve years. The applicant's ar <br />very aware of Pleasanton's Community of Character and are <br />proud to support, demonstrate, and live within those guidelines. <br />Applicants had the side yard light on a motion sensor that was <br />being triggered at night by a neighborhood cat, owned by the <br />Perry's. Mitigation: The applicants have turned off the light unti <br />a proper shroud can be installed so that the Hoehne's are not <br />bothered. <br />Resolution: There are no privacy issues since the proposed <br />addition has no windows located on the Eastern side of the <br />second story addition. In addition the applicant's will continue to <br />respect both audio and visual privacy, as they have since the <br />Perry's moved in.
