Resolution No. PC-2002-77 <br />Page 3 <br />The street design keeps street traffic at satisfactory residential street <br />volumes. The site is free from any toxic or hazardous materials. No <br />earthquake, landslide, flooding, or other natural hazards exist at this site at <br />a level deemed "unacceptable" in the General Plan. <br />The design of the subdivision or the type of improvements does not <br />conflict with easements for access through or use of the property. <br />The existing access easement to the Foley property and other two <br />properties on the south side of the project site would remain. The project <br />developer has agreed to make an open offer of dedication on the final map <br />should the parties desire to make this access into a public street. The <br />project anticipates the conversion of a portion of the Vineyard Avenue <br />("old", or current alignment) right-of--way to private use of the estate lot. <br />This vacation of the portion of the excess roadway right-of--way is <br />consistent with the Vineyazd Avenue Specific Plan. <br />8. The restriction on approving a tentative subdivision map on land <br />covered by a contract entered into pursuant to the California Land <br />Conservation Act of 1965 is not applicable. <br />The site is not covered by such a contract. <br />9. The discharge of waste from the proposed subdivision would not <br />result in violation of existing requirements prescribed by the <br />California Regional Water Quality Control Boazd. <br />No violation currently exists at the wastewater treatment plant. Capacity <br />is available for this subdivision. In addition, the expansion of both the <br />wastewater treatment plant and the Livermore Amador Valley Waste <br />Management Authority export pipeline are likely to be completed by the <br />time this subdivision is occupied. The project would not discharge any <br />waste other than domestic sewage. Urban stormwater runoff is required to <br />meet the City's RWQCB permit requirements for urban development. <br />WHEREAS, the Planning Commission determined that the proposed subdivision is in <br />keeping with the requirements of the previously approved PUD <br />development plan. <br />
