Exhibit "B", <br />PUD-02-4M, Draft Conditions of Approval per Planning Commission <br />Bernal Retail Complex/Service Station, 1875 Valley Avenue <br />August 14, 2002 <br />General Conditions: <br />1. The project covered by this PUD Development Plan approval shall be constructed, main- <br />tained, and operated in substantial conformance to the development plans, Exhibit "A", <br />dated "Received August 9, 2002" on file with the Planning Department, except as modi- <br />fied by the following conditions. Minor changes to the plans may be allowed subject to <br />the approval of the Planning Director if found to be in substantial conformance to the ap- <br />proved exhibits. <br />2. All conditions of Case PUD-02 shall remain in full force and effect, except that PUD-02 <br />is modified to allow the following: <br />a. An additional one-thousand-three-hundred (1,300) squaze feet of building floor <br />area for this site for the carwash structure covered by this approval. This modifi- <br />cation is not transferable, however, and applies only to the approved development <br />plan consisting of aself-service gasoline station, convenience mazket, quick- <br />service restaurant with drive-through lane, and drive-through carwash. Addition- <br />ally, the carwash structure may not be converted to any other type of use other <br />than a self serve carwash unless PUD-02 is further modified, said modification re- <br />quiring review by the Planning Commission and by the City Council. <br />b. The sale of beer and wine only as a conditional use from the convenience mazket. <br />3. The building heights and sepazations shown on the approved development plans, includ- <br />ing setbacks from property lines and sepazations between buildings, shall constitute the <br />development standazds for this site. <br />4. Any changes to the buildings' designs, heights, and separations covered by this approval <br />including, but not limited to, materials, colors, detailing, setbacks, etc., shall be reviewed <br />as an application for design review approval following the procedures listed under Chap- <br />ter 18.20, Design Review, of the Pleasanton Municipal Code. Any changes to the opera- <br />tions of the uses covered by this approval including, but not limited to, hours of operation <br />of the service station, drive-through, etc., shall be reviewed as a modification of the con- <br />ditional use permit approval following the procedures listed under Chapter 18.124, Con- <br />ditional Uses, of the Pleasanton Municipal Code. Based upon the scope of these propos- <br />als, the Planning Director has the discretion to classify a design request as a minor/major <br />PUD-02-4M & PCUP-61 Page 1 of 17 Planning Commission Recommendation <br />
