Resolution No. PC-2002-43 <br />Page 3 <br />Caze was taken during the planning of the Vineyazd Corridor to minimize <br />potential health problems. Adequate setbacks are included from noise <br />quarrying operations and from the relocated Vineyard Avenue. All public <br />utilities aze provided, including City water and sewage disposal. A large <br />setback is included from the planned 230 KV transmission line. Both <br />notice and limitations on agricultural practices are included as <br />requirements, and the residential-viticulture adjacency was found to be <br />compatible in the Specific Plan EIR. No earthquake, landslide, flooding, <br />or other natural hazards exist at this site at a level deemed "unacceptable" <br />in the General Plan. <br />The design of the subdivision or the type of improvements does <br />not conflict with easements for access through or use of the <br />property. <br />No such easements exist. The project dedicates right-of--way where <br />existing utilities lie outside the existing Vineyard Avenue right-of--way. <br />The right-of--way dedication for realigned Vineyazd Avenue gives <br />potential continuous access to the Arroyo del Valle. <br />8. The restriction on approving a tentative subdivision map on land <br />covered by a contract entered into pursuant to the California Land <br />Conservation Act of 1965 is not applicable. <br />The Lonestaz property is still covered by a "Williamson Act" contract. <br />However, it has been non-renewed, and the property may proceed with a <br />tentative map. Prior to approving a final map, the term of the contract <br />must have expired or the remaining years cancelled by action of the City <br />Council. A condition restates this requirement. <br />The dischazge of waste from the proposed subdivision would not <br />result in violation of existing requirements prescribed by the <br />California Regional Water Quality Control Board. <br />No violation currently exists. Capacity is available for this small <br />subdivision. In addition, the expansion of both the wastewater treatment <br />plant and the Livermore Amador Valley Waste Management Authority <br />export pipeline are likely to be completed by the time this subdivision is <br />occupied. <br />WHEREAS, the Planning Commission determined that the proposed subdivision map is <br />consistent with the General Plan and the Vineyard Avenue Corridor <br />Specific Plan. <br />
