Resolution No. PC-2002-39 <br />Page 4 <br />permit. Said landscape plan shall be consistent with the approved landscape plan plus <br />any conditions of approval, and shall be detailed in terms of species, location, size, <br />quantities, and spacing. <br />No trees shall be removed other than those specifically designated for removal on the <br />approved plans. <br />10. Prior to issuance of a building permit, the project developer shall submit a letter signed <br />by the adjoining property owner(s) at 561 Main Street that approves the removal of the <br />two existing trees located directly east of 344 Division Street and shown as Tree # 1 and <br />Tree #2 in the tree report. If the neighboring property owner does not grant permission <br />for tree removal, the appropriate modifications shall be made to the building plans prior <br />to building permit issuance. These modifications aze subject to review and approval by <br />the Planning Director. <br />11. Prior to issuance of a building permit, the Tree Preservation Guidelines detailed in the <br />October 2001 HortScience Tree Report shall be printed on the building plan set. These <br />guidelines shall be followed throughout the development phase of the approved building. <br />12. Prior to issuance of an on-site permit, a tree protection zone shall be established azound <br />each tree impacted by the subject development as detailed in the October 2001 <br />HortScience Tree Report. Tree #7 shall be enclosed by a 6-foot chain link fence or <br />equivalent located a minimum of five feet from the trunk of the tree. No grading, <br />excavation, construction or storage of materials shall occur within that protection zone. <br />13. All new trees used in landscaping shall be a minimum of 24-inch box size and all shrubs <br />a minimum of 5 gallons, unless otherwise shown on the approved landscape plan. <br />14. The project developer shall provide root control barriers and four-inch perforated pipes <br />for parking lot trees, street trees, and trees in planting azeas less than ten feet in width. <br />15. The project developer shall enter into an agreement with the City, approved by the City <br />Attorney, which guarantees that all landscaping and open space areas included in this <br />project will be maintained at all times in a manner consistent with the approved landscape <br />plan for this development. Said agreement shall run with the land for the duration of the <br />existence of the structures located on the subject property. <br />16. Any existing tree, shrub, and/or groundcover on the adjacent properties that is damaged <br />or destroyed by construction activities shall be replaced prior to occupancy. <br />
