Commissioner Sedlak stated that he feels that the direction with the green building provision is good, and he hopes that there is a good balance of green building measures versus what it costs. Discussion ensued regarding clarification of the motion. Commissioner Sullivan amended the motion to include a zero-net energy category for 50 units and to include the Bernal property reallocations which are covered by a development agreement. Commissioner Arkin seconded the amended motion. Discussion ensued regarding the requirement for first-come, first-served projects to be reviewed on a case-by-case basis by the Planning Commission, City Council, and, perhaps the Housing Commission. Commissioner Arkin advised that he would like to see that individuals with one unit not be subject to the review process. Commissioner Sullivan amended the motion to exempt single lot development from the review process, but in no case shall the 350 units per year, as required by the ordinance, be exceeded. Commissioner Arkin seconded the amended motion. The Commission, unable to reach a majority position, directed staff to forward to Council its deliberations, and determined to move on with its agenda. Commissioners Kameny and Roberts returned to the dais. 7. MATTERS INITIATED BY COMMISSION MEMBERS - Commissioner Arkin advised that he would like the Planning Commission to review the flag ordinance with consideration being given to add a provision to prohibit lighting at night in residential areas. Mr. Swift clarified that the City has zoning regulations that flagpoles fit into, but there is no flagpole ordinance per se.
