<br />,- <br /> <br />Chairperson Maas understood Commissioner Arkin's perspective, and agreed that there <br />should be disclosures. She believed that the disclosures should be the responsibility of the <br />real estate agent, and noted that the buyers must take responsibility as well. <br /> <br />Commissioner Sullivan stated that the City was not in the business of selling houses, but <br />was in the business of protecting the public interest. Chairperson Maas agreed with <br />Commissioner Sullivan's point. <br /> <br />Commissioner Arkin would like to see Condition 29 expanded to include the proximity to <br />the airport and the ranch operations. <br /> <br />Commissioner Arkin stated that he liked the idea of using a composite fence, and <br />requested that the applicant work with staff. He preferred the current grading plan, and <br />added that he would be amenable to lowering some homes of the majority desired it. <br /> <br />Commissioner Kameny suggested making the whole house fan an option, to be priced <br />accordingly. <br /> <br />Commissioner Maas moved to approve PUD-14 as recommended by staff, with the <br />following conditions. Commissioner Arkin seconded the motion. <br /> <br /> 1. <br />,--.- 2. <br /> 3. <br /> 4. <br /> 5. <br /> <br />The determination as to the best way to ensure the completion of the vineyard <br />planting would be deferred to staff. <br />Staff will re-examine the grading issue, with the possibility of lowering the <br />houses as stated in Commissioner Sullivan's concerns. <br />Staff will examine the estate home regarding the issues identified by <br />Chairperson Maas. <br />The applicant will look into the option of using composite fencing. <br />The phone lines should be moved to the other side of street, and would only <br />be moved if the expenses were shared by the other developers in the vineyard <br />corridor. Greenbriar will spearhead the discussions with the other developers. <br />6. The whole house fan shall be an option offered to the purchaser. <br />7. There will be a buffer between the vineyards and the oak trees, and crops will <br />not be planted under the canopy. <br />8.
