,--

Commissioner Sullivan advised that he would prefer to see a 30-day continuance, as opposed to
a 60-day continuance, because he would like to see the problem resolved in a shorter time frame.
Mr. Iserson advised that it is probably more realistic for the continuance to be longer than 30
days because it takes time to get everyone together, especially if consultants are needed.

Commissioner Kameny moved to continue this matter for a period of up to 60 days to allow
the applicant, the neighbors, a representative from the Planning Commission and the
Planning staff, as well as any professionals that may be needed to meet to reach an amiable
solution to address the noise emanating from Toby's Bar and Grill. He further moved that
a workable plan shall be brought back to the Planning Commission after the 60-day
continuance. Commissioner Roberts seconded the motion.

ROLL CALL VOTE

AYES:
NOES:
ABSENT:
ABSTAIN:

Commissioners Kameny, Maas, Roberts, and Sullivan
None
Commissioner Arkin
None

The motion carried.

The Planning Commission recessed for a break at 8:20 p.m.

r- Chairperson Maas reconvened the meeting at 8:25 p.m.

10. He further stated that while this tree pole does not have the same color as
the real trees next to it, he feels that it is a good simulation for an artificial tree.

---

May 22, 2002

Page 9

PLANNING COMMISSION MINUTES
