He stated that he feels that this matter should be taken seriously, because the Planning <br />Commissioners said they would when the project was conditioned. <br /> <br />Chairperson Maas stated that she is taking the matter seriously, but she would like to have the <br />residents and the owners see what they can work out and make a decision. <br /> <br />Commissioner Sullivan stated that he had an understanding of the kind of music that would be <br />played, and would have personally opposed the music if it was going to be electric guitars with <br />amplifiers. <br /> <br />Commissioner Kameny noted that he is not in favor of closing the outdoor patio area, and sees <br />the music as the concern. He further noted that he does not want to jeopardize the applicant's <br />business. He stated that he made the original motion to approve the conditional use permit, and <br />at that time he made a request, as noted in the meeting minutes, asking the applicant to be <br />cognizant of the Planning Commission's concerns. He noted that at that time the concerns were <br />related to the potential noise. Commissioner Kameny stated that he concurs with Chairperson <br />Maas in that he does not want to be the judge and jury in this matter, and he feels they need more <br />direction as to how the parties involved can arrive at a solution to this problem. <br /> <br />~ <br /> <br />Mr. Iserson stated that if the Planning Commission is interested in more dialogue, they may wish <br />to continue the item for 60 days, with some specific direction as to the areas they would like to <br />see explored, such as soundproofing and the costs for the kind of soundproofing that would be <br />needed to reach the level required for the noise mitigation. He also stated the consideration <br />might be given to involving a professional consultant to do acoustical readings so that more <br />factual information of a technical sense could be obtained. He stated that they could also <br />consider operational conditions that might be satisfactory to both parties. He suggested that a <br />representative of the neighborhood, the manager of the business, a Planning Commissioner, and <br />a staff person meet to explore these areas to see if the common ground that everyone is hoping <br />for is there and can be achieved without the Planning Commission having to dictate a solution. <br />There was general consensus for support of this recommendation. <br /> <br />Commissioner Kameny stated that he would support Commissioner Maas's suggestion with the <br />addition that staff and some professional consultants be included in the discussions. <br />Commissioner Sullivan indicated that he would also support this recommendation as long as the <br />hours of music operation was one of the elements that was explored. <br /> <br />THE PUBLIC HEARING WAS REOPENED <br /> <br />Chairperson Maas asked if the speakers on this item would agree to meet and discuss this matter. <br />Mr. Convery stated that some of the suggestions that are being made seem rather complicated <br />and costly.
