r- Commissioner Roberts moved to approve Case PDR-l72, subject to the conditions in Exhibit "B," with a modification requiring that the garages be maintained for the parking of vehicles and not be used for storage, and that the architect work with staff to address the concerns expressed by the Planning Commission regarding the architecture. Commissioner Arkin seconded the motion. Commissioner Kameny stated that he supports the application, as well as the condition that the two garages be used for parking vehicles. He asked how this could be enforced. Ms. Kline advised that if it became apparent from off site that garages were not being used as intended and there is a parking problem, staff would have the ability to go back and enforce the requirement. Review of Mid-Term Capital Improvement Proe:ram Steven Bocian presented an overview of the Mid-Term Capital Improvement Program, describing the review process and the materials that have been provided to the Planning Commission. He asked the Planning Commission for comments on any of the projects that are scheduled for funding for the upcoming year and approval of the upcoming projects. He also requested that the Planning Commission provide any general comments on items that should be considered in the Capital Improvement Program. Commissioner Kameny inquired as to the status of the negotiations for the purchase of a 3-acre parcel of the San Francisco property. Mr. Bocian advised that the City is still in negotiations on this site. Commissioner Sullivan asked if the funded project for the installation of a new traffic signal and street alignment at the intersection of Foothill and Muirwood Drive South is contingent on the development of the Merritt property. Mr. Bocian advised that this project is not contingent on development. In response to an inquiry from Commissioner Arkin, Mr. Bocian advised that there may be some issues related to the identified site for the proposed BMX riding park.
