Ms. Kline advised that the <br />r- Planning Commission may wish to consider granting the applicant's request and if noise <br />problems develop there is a condition that would allow these hours to be reviewed. Ms. Kline <br />noted that staff feels the proposal is in keeping with other restaurant uses in the area. <br /> <br />In response to an inquiry from Commissioner Roberts, Ms. Kline confirmed that there is no <br />amplified music outside and that the music comes through speakers. In response to a question <br />from Commissioner Sullivan, Ms. Kline noted that they stop serving meals one hour before <br />closing. <br /> <br />THE PUBLIC HEARING WAS OPENED <br /> <br />COMMENTS FROM THE APPLICANT <br /> <br />The applicant, Dale Morris, 30 W. Neal Street, Suite 110, advised that it would be difficult to <br />move patrons off of the deck at 10:00 p.m. He noted that the noise levels are far worst from the <br />traffic on First Street and that the music outside is not loud. He advised that the music inside is <br />very low-key because of the placement of the tables. He further advised that it is a family <br />restaurant, with a full service bar, but it is rare that they are there late. He noted that the music <br />inside the restaurant is directed away from First Street. <br /> <br />,.- <br /> <br />Commissioner Sullivan asked ifthe deck were to close at 10:00 p.m. would it be possible to stop <br />serving at 9:00 p.m. Mr. Morris advised that this would hamper their ability to be profitable, <br />especially during the summer time when it doesn't get dark until 9:30, in that the deck area is <br />half of the restaurant. <br /> <br />In response to an inquiry from Commissioner Kameny, Ms. Kline provided information <br />regarding the hours of operation and requirements placed on the Vineyards Restaurant when it <br />was at this location. <br /> <br />THE PUBLIC HEARING WAS CLOSED <br /> <br />Chairperson Maas advised that when the Coffee Roast Express was at this location they had live <br />music and there did not seem to be a problem. Commissioner Roberts noted that she sees no <br />problem with extending the hours for serving alcoholic beverages, since other restaurants have <br />that ability. She noted that she would support granting the request and monitoring the noise, <br />especially if patrons would not be seated on the deck one hour prior to closing. <br /> <br />Commissioner Sullivan noted that he has concerns because the other restaurants with extended <br />hours are located more in the core of the Downtown and away from residential areas. He asked <br />what conditions are in place to require that this matter be reviewed should there be problems. <br />Ms. Kline advised that conditions #10 and #11 provide the opportunity for the Planning Director <br />to refer the matter back to the Planning Commission. Commissioner Arkin advised that he is in <br />agreement with what the majority of the Commission is saying.
