<br />Chairperson Maas amended the first sentence under Item #6 on page 8 to read as follows: <br />,-- "Commissioner Maas stated that she does not feel this item really applies to Pleasanton at this <br />time, but would be necessary in the future, and that it is good that it is included." <br /> <br />Chairperson Maas amended the first sentence under Item e. on Page 9 to read as follows: <br />Commissioner Maas commented that Brian Arkin addressed the Housing Element Task Force <br />on Monday evening. . ." <br /> <br />The minutes of the September 12,2001 meeting were approved as revised. <br /> <br />3. REVISIONS AND OMISSIONS TO THE AGENDA <br /> <br />Items 6.e., Review of the 2001 Growth Management Report; and 6.f., PUD-15, Bay Area Self- <br />Storage/Michael Walsh were continued to the September 26, 2001 meeting. Item 6.g., <br />PUD-80-16-19D & 11M, Providian Bancorp, was continued indefinitely. <br /> <br />5. MATTERS CONTINUED FOR DECISION <br /> <br />r- <br /> <br />There were none. <br /> <br />6. PUBLIC HEARINGS <br /> <br />a. PCUP-36. Dale Morris <br />Application for a conditional use permit to serve alcoholic beverages after 10:00 p.m. at <br />the Toby's restaurant to be located at 30 W. Neal Street, Suite 110. Zoning for the <br />property is PUD (Planned Unit Development) - C-O (Commercial-Office) District. <br /> <br />Heidi Jo Kline presented the staff report, describing the application and history of the site, <br />including the previous restaurant uses on this site. She presented the applicant's proposal for <br />days and hours of operation. She advised that notices were sent to property owners and residents <br />within 1,000 feet ofthe site, and staff received calls from two residents who expressed concerns <br />about potential noise impacts. She noted that one of the callers was satisfied with the proposed <br />hours of operation and the second resident asked that the outside deck area be closed at 10:00 <br />p.m. and that no amplified music or drum music be permitted. She also advised that a letter was <br />received today expressing opposition to the conditional use permit, and that letter has been <br />distributed to the Commission this evening. Ms. Kline advised that staff is recommending that <br />the deck area be closed at 10:00 p.m. on Sunday through Thursday, and be permitted to stay open <br />to 11 :00 p.m. on Friday and Saturday. She noted that this recommendation is reflected in the <br />proposed conditions of approval.
