<br />Commissioner Kameny moved to make the conditional use permit findings and approve <br />..- Case PCUP-36, subject to the conditions of approval listed in Exhibit "B." Commissioner <br />Roberts seconded the motion. <br /> <br />Commissioner Kameny asked that the applicant be cognizant of the Planning Commission's <br />concerns and wished the applicant luck on his business. <br /> <br />In response to a request from Commissioner Sullivan, staff provided clarification on the <br />condition regarding closing the deck. <br /> <br />Commissioner Kameny amended his motion to include that Condition #7 be amended to <br />allow the outdoor deck area to be open until 11:00 p.m. on Sunday through Thursday, and <br />12:00 a.m. on Friday and Saturday. Zoning for the property is PUD-I/C-O (Planned Unit <br />Development - Industrial/Commercial-Office) District. <br /> <br />Tricia Maier presented the staff report, describing the proposed project and providing an <br />overview of the processing of this application. She presented a material board for the <br />Commission's information. She noted that the architectural peer reviewer, Mr. Cannon, <br />reviewed the proposed changes and in his letter, which is attached to the staff report, has advised <br />that he is satisfied with the changes that were made in response to the Planning Commission's <br />request. She further noted that Mr. Cannon prefers a tower design and orientation that is <br />different from the applicant's preference. Ms. Maier advised that staff feels that the orientation <br />of the tower as proposed by the applicant is satisfactory. She further advised that staff believes <br />the applicant has followed the Planning Commission's direction regarding the design of the <br />building, noting that it still meets the certified green building rating. Ms. Maier noted that <br />Condition #2 provides for Alternate Tower Design "A" to be used, and if the Commission <br />prefers a different design, this condition would need to modified. <br /> <br />In response to an inquiry from Commissioner Sullivan, Ms. Maier advised that the pedestrian <br />walkway through the berm is approximately nine feet wide.
