b. Actions of the City Council

,,--

No action was taken.

c. Actions of the Zoning Administrator

It was noted that Chairperson Sullivan and Commissioner Arkin appealed the request for an
extension of the PUD approval for the Lemoine project. Mr. Swift advised that this item is
scheduled to be heard at the October 10 meeting. Mr. Swift noted that the method for the appeal
process for the Planning Commission is being studied for all levels of staff approvals and staff
will be developing one clear policy.

In response to an inquiry from Commissioner Maas, Commissioner Arkin advised that he was
not on the Commission when the project was approved and he would like an opportunity to
discuss the project. He further advised that he feels if a project is not developed prior to the
lapsing deadline it should be reviewed. Chairperson Sullivan advised that he appealed the
extension because he did not support the project initially, and that he feels when a project of this
magnitude reaches the end of the approval there should be an opportunity to discuss whether the
approval should be extended.

Mr. Swift clarified that if the final map is approved by the City Council prior to the lapsing date,
there would be no reason to extend the PUD approval.

---

d.

"Draft Compact for a Sustainable Bay Area"

Chairperson Sullivan advised that the Commission has received a copy of the "Draft Compact
for a Sustainable Bay Area" and they have been asked to comment on the draft. Commissioner
Maas questioned whether the Planning Commission had agreed to send a letter with the
Commission's comments. Chairperson Sullivan stated that he thought that is what the
Commission agreed to.

Chairperson Sullivan stated that he would like to make some general comments. He noted that
no matter what ultimately comes out of the development of this document, he feels that the
regionalized dialogue that is taking place is good.

Commissioner Roberts stated that she agrees with Chairperson Sullivan regarding the
opportunity for dialogue, but that she feels the document is very general, and because it is so
politically correct it is difficult to criticize it. She further stated that there are some things in the
document that do not apply to Pleasanton because ofthe way they are worded. She noted that
while these issues should be discussed, she feels some ofthe issues are centered on cities with
larger urban problems.

Commissioner Maas referred to a comment made at the meeting of the Housing Element Task
Force meeting on Monday night related to ABAG's demands. She stated that she agrees with
Commissioner Roberts, in that the City can only do what it can to meet housing requirements.

,--

PLANNING COMMISSION MINUTES

September 12,2001

Page 5
