<br />c. <br /> <br />PV -44/P ADR-369, John Toman <br />Application for a variance from the Municipal Code and administrative design review to: <br />(1) construct an attached garage 21 feet, 6 inches and an enclosed covered breezeway 19 <br />feet, 6 inches from the front property line where 23 feet is the required setback; and (2) <br />locate a portion of the proposed, attached garage greater than 15 feet in height a distance <br />of 14 feet from the residence on the adjacent lot where 17 feet is the minimum separation <br />located at 4222 Bevilacqua Court. Zoning for the property is R-I-6,500 (single-family <br />residential) District. <br /> <br />,-- <br /> <br />Mr. Pavan presented the staff report describing the proposal. Staff provided photos for the <br />Commission's review. Mr. Pavan noted that because of the issues related to visibility, this <br />project has been referred to the Planning Commission for review. He advised that the applicant, <br />Mr. Toman, is in concurrence with the staff report. He noted that there was no neighbor <br />opposition to the project and staff recommends approval. <br /> <br />THE PUBLIC HEARING WAS OPENED <br /> <br />John Toman, 4222 Bevilacqua Court, advised that he met with his neighbor, Dot Dow, this <br />morning and she is total agreement with the proposal. <br /> <br />/""'" <br /> <br />Commissioner Harvey questioned the total amount of square footage that is being added. With <br />regard to the floor area ratio for this property, Mr. Pavan advised that maximum FAR is 40%, <br />however that does not include garage parking spaces. He noted that the entire structure meets <br />this FAR requirement. <br /> <br />Peter Shutts, 4133 Mohr Avenue, advised that he is the architect for the project. He advised that <br />the total building, including the garage and workshop is under the allowed 40% FAR. Mr. Shutts <br />advised that the purpose of the garage is to get cars and RV out of public view. In response to an <br />inquiry from Commissioner Roberts, Mr. Shutts provided information regarding the design of the <br />project. <br /> <br />Commissioner Roberts advised that at a previous hearing on another application, Dorothy Dow <br />had asked that the construction hours be limited to Monday through Friday. She asked if there is <br />a problem with limiting the hours to Monday through Friday. The applicant agreed. <br /> <br />Mr. Toman described the topography and the development of his property. He stated that his <br />direction to the architect was to design a garage that is architecturally compatible with the <br />existing house and which would provide space for getting his vehicles out of sight, while still <br />maintaining his view. He noted that the neighbors are very happy with the proposal. <br /> <br />THE PUBLIC HEARING WAS CLOSED <br /> <br />Commissioner Kameny moved that the variance findings be made and that Case PV -44 <br />and P ADR-369 be approved subject to the conditions of approval in Exhibit "B," with a <br />modification to Condition #6 limiting the hours of construction to Monday through Friday, <br />8:00 a.m. until 5:00 p.m. Commissioner Roberts seconded the motion. <br /> <br />/""'" <br /> <br />PLANNING COMMISSION MINUTES <br /> <br />August 22, 2001 <br /> <br />Page 13 <br />
