Discussion ensued regarding the dimensions of the proposed tree. Mr. Pavan noted that the 24"
--- box tree has the highest likelihood of survival compared to a 36" or 40" box tree. He noted that
it also has a fast growing rate. Mrs. Campbell advised that the nursery has a 20" box tree in
stock and it takes six to eight weeks to order a 24" box tree, but they are willing to order it. She
further advised that the 20" box tree stands at ten feet planted, and has a 5 foot, 5 inch canopy,
and the truck size is about 5 inches.

Mr. Campbell stated that they would consider providing the tree if the appellant was agreeable to
planting the tree on his side of the fence.

In response to an inquiry from Chairperson Sullivan, Mr. Miller advised that he planted a
redwood tree this spring and he does not have another adjacent space for a tree in his yard.

PUBLIC HEARING WAS CLOSED

Commissioner Kameny stated that he feels the matter could be resolved with the planting of a
tree, and he supports staff s recommendation.

Commissioner Harvey stated that he feels the Campbells are trying to be accommodating. He
also stated that he understands that there are space restrictions in both yards.

/"""'

Commissioner Roberts stated that she is not sure the tree will do the Campbells any good. She
suggested that the 20" box tree that is available be allowed. She commented that there appears to
be sufficient vegetation already in the two yards. She noted that she would support staff s
recommendation, but would like whatever is available now be planted, as it would grow much
faster.

Chairperson Sullivan stated that he agrees with Mr. Miller that this would be a visual and privacy
intrusion on his yard where one didn't exist before, and he agrees that something should be done
to help screen it. He noted that he would agree with the other members of the Commission as
long as the type of tree and proposed location is acceptable to the City's landscape architect.

Chairperson Sullivan moved to deny the appeal thereby upholding the Zoning
Administrator's approval of Case PADR-365, with the requirement that a 20" box size
evergreen tree that is ten feet in height, with a five-foot girth be planted, with the species
and the location subject to the satisfaction of the City's landscape architect. Commissioner
Harvey seconded the motion.

ROLL CALL VOTE

A YES: Commissioners Harvey, Kameny, Roberts, and Sullivan
NOES: None
ABSENT: Commissioners Arkin and Maas
ABSTAIN: None

Resolution No. PC-2001-42 was entered and adopted as motioned.

,--

PLANNING COMMISSION MINUTES

August 22,2001

Page 12
