have included a condition of approval requiring the incorporation of these modifications. Mr.
,-- Kishi noted that a LEED score card for the project is included in the staff report.

Mr. Kishi stated that the architect has advised that he has an issue with condition #38 with regard
to construction hours. He reported that the applicant would like to have construction hours of
7:00 a.m. to 5:00 p.m, Monday through Saturday. Mr. Kishi stated that staff feels they can
support the modification.

In response to an inquiry from Commissioner Roberts, Mr. Kishi advised that no comments were
received from the adjacent hotels regarding the proposed hours of construction. Commissioner
Maas suggested that the condition be modified to allow construction to begin at 7:00 a.m., but
that the hours be changed if there are complaints.

Mr. Kishi responded to Chairperson Sullivan's inquiry, noting that condition #13 requires the
installation of conduit up to the roof and a bi-directional electrical meter to provide for the future
installation of photo voltaic panels.

THE PUBLIC HEARING WAS OPENED

COMMENTS FROM THE APPLICANT

r-

Craig Miers of Stark, Miers, Scott Architecture and Planning represented the applicant. Mr.
Miers commented on the approach used to design the building, noting the constraints of the site.
He presented an elevation of the proposed building, describing the building materials, entry focal
point, and components of the stairway. Discussion ensued regarding the color of the glass. Mr.
Miers noted that the color of the glass would not appear as dark as that shown on the color board.
He also noted that either green or blue glass would be acceptable.

Mr. Miers advised that they typically ask the structural engineers to add a point load to support
the installation of satellite dishes, pv cells, etc. He noted that they also provide empty conduit
from the electrical room to the roof. He commented on the pv cell capacity, noting that it would
not supplant the entire building needs, but it would help release the demand.

Mr. Miers commented that with regard to condition #38, they would like to have construction
hours beginning at 7:00 a.m., understanding that if there are any problems, they would have to
change the starting time. With regard to condition # 1 0 which relates to the additional design
changes suggested by Mr. Cannon, Mr. Miers advised that they did implement some of the
suggestions that they feel would improve the project. He stated that they would like to maintain
the square element of the building design and keep the simple classic form, and, therefore, would
not want to add the arches. He stated that they could go with the 8-inch thick wall segment
between the second-floor windows as suggested by Mr. Cannon, but it would give more weight
to the second floor. With regard to the removal of the entry column, Mr. Miers stated that this is
just a matter oftaste and subjectivity.

Mark Barkdull, 3852 Trenery Drive, Pleasanton, advised that he wanted a building that would
stand out on a site that has many large buildings adjacent to it. He stated that he asked the

,--

PLANNING COMMISSION MINUTES

July 11, 2001

Page 6
