<br />In response to an inquiry from Chairperson Sullivan, Mr. Pavan advised that a condition will be <br />,,-- added requiring the homes to be PV solar-ready. <br /> <br />In response to an inquiry from Commissioner Arkin, Ms. Seto reported that the original term for <br />the lease of the antennas was for five years, with two additional five-year renewal periods, and <br />the City will not extend this time because of the opposition expressed by the people in the <br />community adjacent to the antennas. <br /> <br />THE PUBLIC HEARING WAS OPENED <br /> <br />COMMENTS FROM THE APPLICANT <br /> <br />Bob Walsh, the applicant, advised that they have worked with the neighbors to address concerns. <br />He advised that they agree with the staff recommendation, but would like the latitude to <br />construct an accessory structure higher than the 436-foot elevation on the hill. He reported that <br />he has discussed the proposed home office with Mr. John Toman, the one neighbor that would be <br />affected, and he has no problem with this proposal. Commissioner Roberts noted that a structure <br />located up the hill would have views into the home constructed on lot 2. Mr. Pavan advised that <br />in addition to the concerns related to visual impacts, there are also concerns surrounding safety <br />that have been expressed by the Fire Department, with regard to access in the event of i~ury or <br />fire. <br /> <br />,.-- <br /> <br />Dorothy Dow, 4219 Bevilacqua Court, advised that her property adjoins Mr. Toman's property. <br />She noted that she concurs with Mr. Toman not having objections to the project. She noted that <br />they still have concerns about the water issue on this hillside. She advised that the two-lot <br />project is much better than the previously recommended project. She noted that she is absolutely <br />opposed to Saturday construction. She voiced her opposition to any construction higher on the <br />hill. <br /> <br />THE PUBLIC HEARING WAS CLOSED <br /> <br />Commissioner Roberts stated she is happy with the proposal with the addition of the PV <br />condition and the requirement for open fencing on the visible area up the hill, with the exception <br />that privacy fencing be allowed on the sides. <br /> <br />Commissioner Maas noted that two houses are better than four, and the proposed homes are <br />beautiful. She expressed concern about the water issue. Mr. Jost explained that originally it was <br />thought that there was a spring on the property, but it was determined that there was a leak in the <br />water tank. He advised that the matter has not been completely resolved, but the leak is now <br />going into the storm drain system, and water is no longer going into the hill and no water has <br />been found in the hillside at this time. <br /> <br />In response to an inquiry from Commissioner Maas, Mr. Pavan advised that the City has a dust <br />control ordinance with regard to grading. Commissioner Maas stated that she wants to be aware <br />and alert to the current residents concerning this issue. Mr. Jost advised that Condition #86 <br />addresses this matter.
