Commissioner Arkin inquired as to whether the City has the ability to displace the company if
,-- the company which occupies the building changes its use to something that is high traffic. Ms.
Seto advised that the proposed condition provides that power, however there is a lot of
opportunity to work with the property owners in developing creative ways to resolve this issue.

Discussion ensued regarding the types of subsidies and incentives available for trip reduction.

Commissioner Arkin asked if the Hart Middle School principal and other school district
representatives were notified of this project. Mr. Pavan advised that the approval letter and
conditions of approval will be sent to the principal within the appeal period. Commissioner
Arkin requested that this be followed up with a telephone call.

Discussion ensued regarding the addition of public art on this site. Commissioner Roberts stated
that she is opposed to demanding that a piece of art be required, as she feels this is not
necessarily art. Commissioner Arkin stated that he would like to see the condition related to this
item. Mr. Pavan advised that it appears that the condition was inadvertently omitted, but that it
can be added.

THE PUBLIC HEARING WAS OPENED

COMMENTS FROM THE APPLICANT

r--

Paula Francis, South Bay Development Company, 1690 Dell Avenue, Campbell, CA 95008,
represented the applicant, advising that she is available to respond to questions.

Commissioner Harvey asked if there is an opportunity to provide for some percentage of power
for the existing structure on the roof of the expansion by enhancing the structure of the expanded
part of the building. Ms. Francis advised that there may be some potential and they would be
agreeable to exploring the feasibility.

Commissioner Harvey suggested that waterless urinals be considered. Ms. Francis advised that
they would explore this suggestion.

THE PUBLIC HEARING WAS CLOSED

Commissioner Roberts moved approval of Case PUD-81-30-49D-IM subject to the
conditions of approval in Exhibit "B," with the following additions:
.
