Mr. Swift advised that the City will hold a bond and there will be an improvement <br />plan before the final map can be recorded, and lots cannot be sold until a final map is recorded. <br /> <br />Discussion ensued regarding the amount of the bond that would be required, how the bond <br />process functions, and the final map process. <br /> <br />Mr. Swift advised that the actual improvements to realize the Vineyard Corridor infrastructure <br />will be part of the Deleo subdivision, and the only improvements left for the Costas property to <br />complete would be the cul-de-sac to serve four ofthe Costas lots. He further advised that the <br />other two Costas lots will be served by streets constructed by Delco. Mr. Swift clarified that Mr. <br />Costas purchased his lots back from Deleo following the PUD approval process. <br /> <br />Commissioner Maas referred to the letter from Data Sales which the Planning Commission <br />received this evening. Mr. Swift advised that all three issues in the letter are addressed through <br />staffs recommendation to modify Condition #6. <br /> <br />Commissioner Arkin asked for clarification regarding the school fees. Mr. Swift advised that <br />Mr. Costas will be required to sign a school fee agreement. Mr. Swift clarified that Mr. Costas is <br />not part of the agreement between Delco, Greenbriar, Centex, and the School District to front the <br />costs of some of the infrastructure. <br /> <br />r- <br /> <br />Commissioner Kameny referred to the Open Space Management Plan and asked if the reference <br />to open space areas should read Parcels C and "D," rather than Parcels "B" and C. Mr. Swift <br />confirmed that Commissioner Kameny is correct. <br /> <br />Mr. Swift stated that there are a number of issues that the applicant has discussed with the <br />Engineering Department and that Delco will review its requests for modifications to the <br />conditions of approval that pertain to these matters. <br /> <br />In response to an inquiry from Commissioner Maas, Mr. Swift clarified the process for the <br />development and design review of the Hahner property parcels. <br /> <br />In response to a question from Chairperson Sullivan regarding the land trust easement, Mr. Swift <br />advised that the City Council determined that the easement would be made to the City, with the <br />Land Trust as a third party beneficiary, and the City Council directed staffto work out the final <br />language for the easement. Ms. Seto advised that language has not yet been finalized. <br /> <br />Chairperson Sullivan questioned the PUD condition requiring that the vineyard must be planted <br />prior to the construction of the final 25% of the houses. He asked for clarification as to how this <br />would work with the separation of the Delco and Costas developments. Mr. Swift advised that <br />the PUD is the entire project. Chairperson Sullivan stated that potentially 27 of the 30 houses on <br />the Hahner property could be constructed before the vineyard is installed, and the vineyard might <br />not go in ifthe Costas houses are not built.
