<br />PUBLIC HEARING WAS OPENED <br /> <br />r- <br /> <br />COMMENTS FROM THE APPLICANT <br /> <br />John Modica, 3687 Old Santa Rita Road #27, clarified that this will not be a used car lot and that <br />their business is the modification of vehicles. He noted that they are required to have a dealer's <br />license so that they can attend auctions to purchase vehicles. He advised that a modified vehicle <br />would be displayed on the showroom floor just prior to the customer taking delivery. He stated <br />that there will be no vehicles parked outside the building with "for sale" signs, there will be no <br />signage on the existing building stating that they are a car lot of any kind, and all sales will be <br />done privately, with advertisements through car magazines <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />Commissioner Maas moved that the conditional use permit findings be made and approval <br />of Case PCUP-28, subject Exhibit "B." Tentative Tract Map 7240, Mardel L.L.C. (Deleo Builders) <br />Application for a vesting tentative subdivision map to allow the subdivision of a 41.1- <br />acre site into 38 building lots including one vineyard/estate lot, two non-buildable <br />parcels, and miscellaneous public infrastructure improvements including public streets, <br />landscaping, utilities, etc. The subject properties are located at 2503 Vineyard Avenue <br />and 2287 Vineyard Avenue in the Vineyard Avenue Corridor Specific Plan Area, and are <br />zoned PUD (Planned Unit Development) - Vineyard/OS/LDR/MDR (Vineyard/Open <br />Space/Low Density ResidentiallMedium Density Residential) District. <br /> <br />Commissioner Roberts advised that since the PUD was approved, the Fair Political Practices <br />Bureau extended the boundary line for conflict of interest, so while she did not have a conflict of <br />interest before, she does now, and is, therefore, abstaining on this item. <br /> <br />Mr. Swift presented the staff report, noting that the PUD conditions of approval required that a <br />number of items be addressed at the time of the tentative map, and that these areas are discussed <br />in the staff report. He noted that many of these items have been included on the exhibits and <br />others are addressed through the conditions of approval. He advised that staff finds the tentative <br />map to be consistent with the PUD and is recommending approval as conditioned.
