<br />ROLL CALL VOTE <br /> <br />r- <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Commissioners Arkin, Kameny, and Roberts <br />Commissioners Maas and Sullivan <br />None <br />None <br /> <br />Resolution No. PC-200 1-19 was entered and adopted as motioned. <br /> <br />Commissioners Maas expressed her disappointment that the two parties did not meet, in light of <br />the Planning Commission's recommendation that the fence would be removed if there was no <br />resolution. <br /> <br />In response to a question from Commissioner Arkin, Commissioner Maas advised that she asked <br />for information regarding the fees because she was looking at the possibility of the Lus seeking <br />retribution from the builder and if any fees were not paid, she wanted to be sure that the fees <br />were collected. She commented that there is no deterrent to prevent construction without <br />appropriate approvals and permits. <br /> <br />The Planning Commission directed staff to bring any proposals for solid wood fencing in <br />the Bethel Lane area to the Planning Commission for review. <br /> <br />b. <br /> <br />PUD-05. Centex Homes <br />Application of Centex Homes for approval of a PUD development plan which would <br />create 19 single-family detached homes on approximately half-acre lots within the 14.9- <br />acre "Low Density Residential"-designated area of the Chrisman and Berlogar properties; <br />would establish zoning regulations for the remainder of the Chrisman parcel, including <br />retention of the existing house; and would relocate the existing caretaker unit on the <br />Berlogar parcel to a new location within the "Hillside Residential"/"Open Space" portion <br />of that lot. The project is located at 1944 and 2190 Vineyard Avenue. Zoning for the <br />properties is PUD (Planned Unit Development) District, with the uses as specified in the <br />Vineyard Avenue Corridor Specific Plan. <br /> <br />- <br /> <br />Continued to May 9, 2001. <br /> <br />6. PUBLIC HEARINGS <br /> <br />a. PCUP-28. John Modica d.b.a. Modacar Auto Accessories and Wilfred Toy <br />Application for a conditional use permit to conduct automobile sales within an existing <br />service commercial suite located at 3687 Old Santa Rita Road, Suite 27. Zoning for the <br />property is PUD - c-o (Planned Unit Development - Commercial-Office) District. <br /> <br />Mr. Swift presented the staff report, providing an overview of the proposal. He advised that staff <br />finds that the change is only a marginal modification to the existing use on the site.
