Discussion ensued regarding the size of Parcel "A" and the possibility of moving <br />the day care center away from the power lines. UP-99-48, Tri-City Baptist Church <br />Application for a conditional use permit approval to operate a private school of <br />approximately 50 students between the hours of 8:00 a.m. to 3 :00 p.m., Monday through <br />Friday, at the existing Evangelical Free Church located at 6900 Valley Trails Drive. <br />Zoning for this property is R-I-6,500. <br /> <br />Tricia Maier presented the staff report. She provided background regarding the proposal and <br />presented information related to the landscaping issues. She described the proposed landscape <br />plan, noting that Phase I of the plan has been implemented and that staff supports the landscape <br />plan. Ms Maier advised that she recently spoke with the Vice President of the Valley Trails <br />Homeowners Association and he indicated that the HOA is very pleased with the improvements <br />that have been made. She commented on the letter distributed to the Planning Commission from <br />Mr. Pretzel requesting a condition of approval that would allow the surrounding neighbors direct <br />recourse if the church does not comply with the conditions of approval. Ms. Maier noted that <br />staff feels that Condition #2 accomplishes this goal. She noted that Mr. Pretzel is requesting that <br />the condition be modified to indicate that other impacts specifically include "lack of maintenance <br />on the site and/or lack of progress on implementation of Phase II and III of the landscaping <br />plan."
