Additional Obligations of Licensor: In addition to those obligations set forth in Section 9 of the License Agreement, Licensor shall also provide the following relative to the I loliday Ice Rink operations no later than November 9, 2009 and the starting dates for 201 I and 2012 as set forth in Exhibit "3" and the extension term. if any: • 3- phase, 480 -volt, 600 -amp continuous power source for refrigeration (208 -volt optional with additional transformer): electrical connection by qualified professionals from the chiller to the power source, 100 -volt power source fin tools/kiosk/sound /lighting. • A level clean Rink Site as depicted on Exhibit "B" of the License Agreement • Continuous uninterrupted water source directly adjacent to the Rink Site area • Placement of refrigeration system as close to the Rink surface as possible • Two (2) telephone lines with service delivered to the Rink ticket and skate rental kiosk/tent • Identified and reserved public parking as close to Rink Site for Licensee's operational personnel • General security personnel presence -after hours seven (7) days a week during operation of the Rink • Coordination and procurement of all permits and licenses required for the installation and operation of the equipment and any special event, if required, relative to the Rink's operation • Any and all sales and use taxes, occupational taxes, and any other license or ice levied upon Licensee regarding the rental of equipment, the providing of labor, the execution of the Rink installation, or any future State Entertainment/Admissions tax • Downtown Banner on Main Street prior to the beginning of each year's I loliday Rink Opening Date 10
