Operable Windows <br />CLC intends to design and construct the Independent Living Units with operable <br />windows. As such, Attachment 1 reflects that the draft condition of approval allowing <br />closed windows as a possible exterior to interior noise reduction feature has been <br />removed. <br />Photovolatics <br />As conditioned, all of CLC's units will be constructed to allow for the future installation of <br />Photovolatic (PV). <br />To further reduce regional air quality impacts, the applicant has also agreed to install PV <br />panels on the flat portion of the Central Plant's mansard roof. A condition of approval <br />addressing this matter is also included in Attachment 1. <br />Tree Preservation and Removal <br />When CLC's tree report was originally prepared there were 69 trees on site. Since <br />then, one tree failed and approximately 10 trees (plus additional smaller trees) were <br />removed after a certified arborist deemed them an immediate threat to persons and <br />property. Of the ten trees removed, three were originally proposed to be preserved. <br />Staff has modified the tree preservation condition such that these three trees are no <br />longer required to be preserved. With the condition as modified, 35 existing trees will <br />remain. <br />As conditioned, CLC will plant more than 1,300 new trees on /adjacent to the project site <br />including additional trees by the western property line which will be planted such that <br />there will be no visible gaps between the trees once mature. <br />Lighting <br />At the August 24 meeting staff indicated it would provide additional information <br />regarding LEED lighting and the light standards required for the Staples Ranch <br />development, including off -site light spillover for the auto mall. <br />LEED Lighting <br />Commercial and park projects can obtain a LEED point (1 point) if they meet LEED's <br />light pollution requirements. The design treatments necessary to achieve the point <br />depend on the type of project proposed. For a park to achieve this point, exterior <br />lighting can only be for safety or comfort reasons. Likewise, light spillover (onto <br />neighboring properties) can only be 0.01 foot candle. This requirement is not <br />compatible with the proposed lighting at the Neighborhood Park which includes two <br />lighted tennis courts, restroom and plaza area.
