FINANCIAL IMPACT <br />There is no financial impact to the City as a result of these supplemental staff <br />recommendations. <br />DISCUSSION <br />The City Council's August 24, 2010 approval of the Staples Ranch environmental <br />documents included a number of amendments to the CLC project relating to: <br />construction hours, high efficiency particulate air filters (HEPA) or other filters, operable <br />windows, and photovotalics. There was also a request for more information related to <br />off -site light spillover, particularly related to the auto mall. In response, this report <br />outlines the proposed PUD changes to the CLC conditions of approval (which are <br />included in Attachment 1) and provides the information requested regarding project <br />lighting. In addition, staff now has the parcel numbers for the tax sharing agreement <br />(Attachment 2) and staff recommends two, minor non - substantive changes to the <br />Development Agreement to assure consistency with other documents (Attachment 3). <br />Recent tree removals on the CLC site are also addressed below. <br />Modifications to the Draft PUD Conditions of Approval for the CLC Project <br />Construction Hours <br />At the August 24, 2010 Council meeting, the Council considered changes regarding <br />CLC's construction hours as set forth in the Mitigation Monitoring and Reporting <br />Program (MMRP) to address concerns regarding Saturday construction impacts on <br />neighbors closest to the CLC project. As originally drafted, CLC's conditions would <br />allow Saturday construction from 8:00 a.m. to 5:00 p.m., with a caveat that if the <br />Director of Community Development receives any complaints, the Director may modify <br />or revoke the Saturday construction hours. To be consistent with City Council direction, <br />Attachment 1 includes a modification to the PUD conditions limiting CLC's site grading <br />activities to 8:00 a.m. to 5:00 p.m. Monday to Friday. This should significantly reduce <br />noise and dust from construction on Saturdays. The applicant has agreed to this <br />modification. It should be noted that the proposed PUD conditions require that during <br />construction CLC will have a noise disturbance coordinator to address any noise - related <br />concerns. A plan to control dust during construction is also required. <br />Air Filtration <br />Concerning City Council action regarding CLC's Health Risk Assessment, Attachment <br />1 includes a modification to the proposed CLC conditions of approval reflecting that <br />Independent Living Unit Buildings (ILU) #5 and #6 will be located outside the 247' <br />setback from the existing edge of the southern travel lane of 1 -580 and that an air <br />filtration system, either HEPA or other similar air filtration system as approved by the <br />Director of Community Development, will be installed in the northern most units in ILU <br />#5 and ILU #6, even though these ILU buildings will be relocated outside the 247' <br />setback. Again, the applicant has agreed to this modification. <br />Page 2 of 5 <br />
