THE CITY OF <br />pLE ASANTONC <br />CITY COUNCIL AGENDA REPORT <br />14 <br />Supplemental Report <br />September 7, 2010 <br />City Manager's Office/ <br />Community Development Department <br />TITLE: SUPPLEMENTAL REPORT TO CASES PUD -57, PUD -68, AND PUD -80 <br />ESTABLISHING PLANNED UNIT DEVELOPMENT PLANS INCLUDING <br />ALLOWED USES FOR HENDRICK AUTOMOTIVE GROUP, <br />CONTINUING LIFE COMMUNITIES, AND A NEIGHBORHOOD <br />PARK/STORMWATER DETENTION BASIN AT STAPLES RANCH, AND <br />APPROVAL OF AGREEMENTS FOR THE STAPLES RANCH <br />PROJECT <br />SUMMARY <br />This report addresses City Council action taken at its August 24, 2010 meeting requiring <br />minor amendments to the proposed PUD conditions of approval for the CLC Project <br />regarding environmental conditions; City Council also requested information regarding <br />off -site light spillover. In addition, this report updates the tree preservation conditions for <br />Continuing Life Communities' (CLC's) site. This report also includes minor revisions to <br />two agreements: 1) Exhibit A of the Tax Sharing Agreement now includes the relevant <br />parcel numbers of the parcels that are to be annexed (a complete list was unavailable at <br />the time the initial report was prepared); and 2) two minor non - substantive changes to <br />the Development Agreement to be consistent with other agreements. Except as <br />provided in this report, all information included in the September 7, 2010 Agenda Report <br />that was distributed in early August remains unchanged. <br />STAFF RECOMMENDATION <br />(These recommendations are in addition to the staff recommendations set forth in the <br />original September 7, 2010 Agenda Report.) <br />Staff recommends the Council take the actions listed in the original September 7, 2010 <br />Agenda Report with the following staff recommended modifications: <br />1. Modify the draft PUD conditions of approval for the CLC project as shown <br />in Attachment 1 of this supplemental report. <br />2. Modify Exhibit A of the Tax Sharing Agreement as shown in Attachment 2 <br />of this supplemental report. <br />3. Modify Sections 3.06 and 6.03 of the Development Agreement as shown <br />in Attachment 3 of this supplemental report. <br />4. Authorize staff to modify the Tax Sharing Agreement, if necessary, to <br />meet LAFCO's requirements. <br />
