ATTACHMENT 1 <br /> AGREEMENT FOR ART WORK <br /> Jill Turman <br /> THIS AGREEMENT FOR ART WORK ( "Agreement ") is made and entered into as of the <br /> 17th Day of August, 2010, by and between the CITY OF PLEASANTON, a municipal corporation <br /> ( "City ") and Jill Turman, dba Bella Ironworks, ( "Artist "). <br /> RECITALS <br /> A. City desires to commission and acquire two (2) sculptural bike racks (the "Work ") <br /> which have been conceived and designed by Jill Turman (the "Artist ") to be installed at sites near <br /> the entrances of the Firehouse Arts Center building in Pleasanton, California (the "Site "). <br /> B. Artist has provided a design and maquettes for the Work and will fabricate the Work <br /> according to the approved design. <br /> C. Artist will collaborate with City to determine the location and manner in which the <br /> Work shall be securely installed and fabricate the Work accordingly, then deliver the Work to the <br /> City ready for installation and assist with the installation thereof <br /> D. Artist desires to transfer ownership of the Work to City and City desires to accept <br /> ownership of the Work, upon installation and final acceptance thereof by City and full payment <br /> therefore by City. <br /> NOW, THEREFORE, in exchange for mutual consideration, the parties agree as follows: <br /> 1. COMMISSION FOR WORK BY ARTIST. City hereby commissions the Artist and <br /> the Artist hereby accepts the commission and shall design the Work as generally described in the <br /> attached Exhibit A. <br /> a. Fabrication. Upon final acceptance and approval of Final Design Documents, and <br /> maquettes, Artist shall fabricate the Work, as generally described in Exhibit A, in consultation with <br /> the appointed project Landscape Architects and Construction Engineering firm. Fabrication shall <br /> commence with 20 days' advance notification by the City, and shall take no more than 120 <br /> calendar days to complete. <br /> 1) Artist will construct two (2) sculptural steel bike racks, each an original design, <br /> according to her proposal, and finish them with industrial grade paint in the colors specified on said <br /> proposal (the "Work "). <br /> 2) Artist will procure necessary installation materials and the City will provide the <br /> necessary surface preparation. <br /> 3) Artist will assist in the installation of the Work. <br /> Page 1 of 7 <br />
