Installation of an interim traffic signal at the Bernal Avenue/ Vineyard Avenue <br /> intersection, and construction of a partial roadway widening on Bernal Avenue just <br /> south of the Arroyo Del Valle. <br /> . Interim modifications to improve traffic movement at the Bernal Avenue and <br /> Vineyard Avenue intersection and on Vineyard Avenue including the installation of <br /> traffic mast arms and signal heads, installation of median curbing, and widening of <br /> Vineyard Avenue. <br /> . Sanitary sewer improvements including the installation of 18" sanitary sewer lines <br /> and appurtenant structures on Bernal Avenue through the Vineyard and Bernal <br /> Avenue intersection in advance of repaving the roadway intersection. <br /> . Acquisition of mitigation credits ($7,000) for the preservation of Red - legged Frog <br /> habitat from Ohlone Preserve Conservation Bank. <br /> DISCUSSION <br /> Mitigation for wetland and riparian habitat was accomplished both on -site and off -site in <br /> accordance with the environmental permit requirements (Nationwide 401 Permit). The <br /> on -site mitigation area is located in the Arroyo Del Valle adjacent to the bridge, while the <br /> off -site mitigation area is located at the southeast corner of Valley Avenue and Laguna <br /> Creek Lane, adjacent to Mission Creek on the Bernal Property. The use of the Bernal <br /> property for wetland and riparian mitigation complied with the Bernal Property Specific <br /> Plan, which designated this area as agricultural. Per the Specific Plan, agricultural uses <br /> were anticipated to provide "hands -on" lessons in the natural sciences and ecology and <br /> to provide for a living classroom experience. An observation deck will be evaluated and <br /> installed at a later date to foster these learning activities as stated in the Specific Plan. <br /> Therefore staff recommends that $100,000 to be reserved under the project account for <br /> this anticipated project. <br /> Long- term monitoring to assess the performance of the wetland and riparian mitigation <br /> effort will be conducted for a total of five years to ensure performance standards have <br /> been met and that United States Army Corps of Engineers (USAGE), Regional Water <br /> Quality Control Board (RWQCB) and California Department of Fish and Games (CDFG) <br /> mitigation requirements have been fulfilled. The mitigation monitoring effort includes <br /> site monitoring, habitat monitoring, hydrologic monitoring, and annual reporting. On <br /> March 16, 2010, the City Council approved a contract amendment with Mosaic <br /> Associates for a not -to- exceed amount of $115,194 to provide the required monitoring <br /> and reporting services. Performance of mitigation sites for the next 4 years or until <br /> accepted by the regulatory agencies is unpredictable and may require <br /> correction /adjustment. Therefore, staff recommends that the remaining balance of the <br /> project account to be remained to cover both the initial contract amount with Mosaic as <br /> well as any additional remedial measures necessary as a result of the monitoring <br /> efforts. <br /> The Department of Parks & Community Services has accepted both mitigation sites as <br /> part of the Parks Division's on -going maintenance routine of planted areas. <br /> Page 3 of 4 <br />
