OPERATOR and subcontractors shall comply with the provisions of the Fair Employment and <br /> Housing Act (Government Code, Section 12900 et seq.) and the applicable regulations <br /> promulgated hereunder (California Code of Regulations Title 2, Section 7285.0 et seq.). The <br /> applicable regulations of the Fair Employment and Housing Commission implementing <br /> Government Code, Section 12900, set forth in Chapter 5 of Division 4 of Title 2 of the <br /> California Code of Regulations are incorporated into this Agreement by reference and made <br /> part hereof as if set forth in full. <br /> OPERATOR and its subcontractors shall give written notice of their obligations under <br /> this clause to labor organizations with which they have a collective bargaining or other <br /> agreement. OPERATOR shall include the nondiscrimination and compliance provisions of this <br /> clause in all subcontracts to perform work under this Agreement. OPERATOR shall permit <br /> access by representatives of the Department of Fair Employment and Housing and CITY upon <br /> reasonable notice at any time during normal business hours, but in no case Tess than 24 hours' <br /> notice, to such of its books, records, accounts and other sources of information and its facilities <br /> as said Department or CITY shall require to ascertain compliance with this clause. <br /> 5.05 Drug Free Workplace. OPERATOR shall certify that it complies with Sections 8350- <br /> 8355 of Chapter 5.5 of the Government Code, Drug Free Workplace Act. <br /> 5.06 Signs. OPERATOR shall be responsible for installing and maintaining all signage <br /> necessary for the Golf Course operations. The cost of such signage shall be considered Direct <br /> Costs. OPERATOR shall not post outdoor signs at or on the Premises without the prior written <br /> approval of the Director, as well as the approval of the Planning and Community Development <br /> Department, as required by law, with the exception of temporary directional or advisory signs <br /> (e.g. "Front entrance closed; use side entrance;" "Temporary no parking area;" "Wet Steps. <br /> 5.07 Publicity. Any commercial advertisements, press releases, articles, or other media <br /> information not provided for in the Annual Marketing Plan and Budget shall be subject to the <br /> prior approval of CITY, which approval shall not be unreasonably withheld. <br /> 5.08 Utilities. OPERATOR shall be responsible for arranging for utility service for the <br /> Premises, including but not limited to water, gas, electricity, sewer and trash removal. <br /> OPERATOR's costs for such utility service, as well as OPERATOR's costs incurred in <br /> correcting any defect, deficiency or impairment of any utility system, water system, water <br /> supply system, drainage system, water system, heating or gas system or electrical apparatus or <br /> wires serving the Premises, shall be Direct Costs. <br /> 5.09 Safety and Security. OPERATOR shall exercise caution at all times for the protection <br /> of persons and property. OPERATOR shall maintain adequate and appropriate safety guards <br /> and protective devices for all existing equipment and machinery and shall install adequate and <br /> appropriate safety guards and protective devices for all new equipment and machinery. <br /> OPERATOR shall post appropriate caution signs to alert personnel or the public of unsafe <br /> conditions. OPERATOR shall comply with all applicable laws relating to safety precautions, <br /> including, without limits, the safety regulations of the California Division of Industrial Safety, <br /> OSHA. OPERATOR shall immediately correct any unsafe condition of the Premises, as well <br /> 25 <br />
