course superintendent is desired. OPERATOR shall have an employee licensed as a Pest <br /> Control Advisor in categories A, B, D and E who will be available to consult with <br /> Superintendent. The Superintendent shall be responsible for the maintenance of the buildings, <br /> equipment and grounds of the Golf Course. <br /> c) Golf Professional. The Golf Professional shall be a current Class "A" <br /> member in good standing with the PGA or LPGA and have three (3) years of experience as a <br /> golf professional. If the General Manager is a current Class "A" member in good standing with <br /> the PGA or LPGA, then the Golf Professional may be an PGA or LPGA Class "A" apprentice. <br /> The Golf Professional shall be responsible for golf instruction, golf services and the Pro Shop. <br /> The Golf Professional shall report directly to the General Manager. The Golf Professional's <br /> lesson plan and operational information shall be submitted quarterly to the Director. <br /> d) Food Service Manager. The Food Service Manager shall be responsible for <br /> the Food Service Facilities and providing food and beverage services. The Food Service <br /> Manager shall report directly to the General Manager. The Food Service Manager shall have a <br /> high school diploma, preferably some college related courses and at least two (2) years of food <br /> and beverage supervisory experience. <br /> 5.03 Contracts and Agreements. All third -party contracts relating to the operation and <br /> maintenance of the Golf Course (including without limitation golf professional contracts, <br /> contracts for maintenance and repair services, pest control, supplies, and landscaping services, <br /> and contracts for tournaments, banquets, and other group functions) shall abide by the <br /> requirements in this section, which shall be included in the contract. Except as provided in this <br /> Agreement, all leases and financing agreements for Furnishings and Equipment, and all <br /> contracts and agreements relating to the operation and maintenance of the Golf Course entered <br /> into during the term of this Agreement, shall be entered into by OPERATOR as the contracting <br /> party. If the term of the lease, financing agreement, or other contract or agreement is for more <br /> than one year, extends beyond the term of this Agreement or the date for performance under <br /> such lease, agreement or contract is after this Agreement terminates, then prior approval of the <br /> Director is required. If the Director has approved the lease, agreement or contract, CITY shall <br /> assume any assignments of such lease, agreement or contract. <br /> 5.03.1 Contracting Procedures <br /> a) Purchases over $10,000. For purchases over $10,000, excluding Resale <br /> Inventory, OPERATOR shall obtain at least three (3) informal bids, except those purchases that <br /> are part of an OPERATOR national pricing contract or otherwise justified and approved by the <br /> Director. OPERATOR shall retain records related to the informal bids for review by CITY. <br /> b) Emergency Expenditures. OPERATOR shall be entitled to make additional <br /> expenditures not authorized under the then applicable Annual Plan in the event of an <br /> emergency, which may result in immediate damage or danger to life or property, or in order to <br /> comply with any immediate Legal Requirements or Insurance Requirements. <br /> 23 <br />
