of per diem wages, and not less than the general per diem wages for holidays and overtime <br /> work, for each craft, classification or type of worker needed to execute the work under this <br /> Agreement shall be paid to all workers, laborers and mechanics employed in the execution of <br /> the work by the OPERATOR or any subcontractor doing or contracting to do any part of the <br /> work. The appropriate determination of the Director of the California Department of Industrial <br /> Relations shall be filed with, and available for inspection, at the City offices. OPERATOR <br /> shall post, at each job site, a copy of the prevailing rate of per diem wages. OPERATOR shall <br /> forfeit fifty dollars ($50.00) for each calendar day or portion thereof for each worker paid less <br /> than the stipulated prevailing rates for any public work done under the Agreement by <br /> OPERATOR or by any subcontractor. <br /> 5.02.4 Employee Benefits. OPERATOR shall have the obligation to provide all legally <br /> mandated employee benefits to its employees. OPERATOR shall have the right to provide its <br /> eligible employees with pensions and other employee retirement benefits and disability, health <br /> and welfare benefits, and other benefit plans now or hereafter available to employees of other <br /> golf courses operated or managed by OPERATOR, and the allocable share of such employee <br /> benefits accrued while working at the Golf Course shall be a Direct Cost. <br /> 5.02.5 Temporary Assignment of Other OPERATOR Personnel. If the positions of <br /> General Manager, Course Superintendent, Golf Professional or Food Service Manager are not <br /> filled for whatever reason, OPERATOR shall permanently fill those positions within 90 days. <br /> OPERATOR may temporarily assign to these positions the staff of other golf courses and <br /> country clubs operated or managed by OPERATOR. During such time as these employees are <br /> temporarily assigned to the Golf Course, all such employees will be paid their regular <br /> Compensation, and the pro -rata share of such employees' Compensation equal to the actual <br /> time such employees worked at the Golf Course shall be a Direct Cost. <br /> 5.02.6 Management Staff. The Management Staff shall be the following four (4) full <br /> time positions that will be solely dedicated to the Golf Course: the General Manager; Golf <br /> Course Superintendent; Golf Professional; and Food Service Manager. CITY shall approve the <br /> Management Staff and shall be informed prior to the termination or transfer of any of the <br /> Management Staff. <br /> a) General Manager. The General Manager of the Golf Course shall be <br /> responsible for the day -to -day management and operation of the Golf Course. The General <br /> Manager must have a college degree and at least five (5) years experience as a golf course <br /> operations manager or assistant. The name and telephone number (both home and business) of <br /> the General Manager shall be provided, in writing, to City and shall be current at all times. The <br /> General Manager shall be reasonably available during normal working hours to meet with the <br /> Director. After normal working hours, the General Manager shall be reasonably available to <br /> appear at the Golf Course if deemed necessary by the Director. The General Manager <br /> compensation for providing golf lessons shall not net more than $5,000 per year. <br /> b) Superintendent. The Superintendent for the Golf Course shall be a current <br /> Class "A" member in good standing of the Golf Course Superintendents Association and have a <br /> Qualified Applicators Certificate "QAC in categories B and F.
