13. That all buildings and/or structures must comply with all <br /> codes and ordinances in effect at the time required permits <br /> are issued by the Building Department. <br /> <br />14. That the developers' contractor obtain an encroachment permit <br /> from the City prior to the beginning of construction. <br /> <br />15. That the developer pay any and all fees that the property may <br /> be subject to. <br /> <br />16. That any damage to street improvements now existing or done <br /> during construction, be repaired by the developer to the <br /> satisfaction of the City Engineer. This work shall include <br /> patching, reconstruction, slurry seal, and/or overlay if <br /> considered necessary by the City Engineer. <br /> <br />17. That except as otherwise established by these conditions, the <br /> site standards and uses of the units in the project shall be <br /> those of the R-1-20,000 District. <br /> <br />18. That the use of the non-standard thirty-five (35 foot) curb <br /> radius (40 ft. R/W radius) cul-de-sac be approved by the <br /> Planning Commission and Fire Marshal, and receive f~nal <br /> approval from the City Engineer. <br /> <br />19. That prior to the approval of any final map on the subject <br /> property, the developer enter into an agreement with the City <br /> for the maintenance of all private roads, the language of <br /> said agreement to be approved by the City Attorney. <br /> <br />20. That each developer shall make an in-lieu payment to the City <br /> prior to Council approval of the final map for that <br /> development. This payment shall be for the developer's <br /> proportionate share of the traffic signal installation at the <br /> intersection of Santa Rita Road and "Trenery Drive." The <br /> amount of this payment shall be determined prior to the <br /> approval of the tentative map. <br /> <br />21. That the proposed forty foot (40 ft.) wide, private, <br /> north/south streets between the Skinner parcel and the <br /> Singleton parcel and between the Combs parcel and the <br /> Cartlidge parcel be constructed to their full proposed <br /> curb-to-curb width of twenty-eight foot (28 ft.) or larger. <br /> If these streets are not constructed as through streets at <br /> the time of development, any cul-de-sacs or turn-arounds used <br /> shall be subject to the approval of the Fire Marshal and the <br /> City Engineer. <br /> <br />22. That the developer acknowledges that the City of Pleasanton <br /> does not guarantee the availability of sufficient sewer <br /> capacity to serve this development by the approval of this <br /> case, and that the developer agrees and acknowledges that <br /> building permit approval may be withheld if sewer capacity is <br /> found by the City not to be available. <br /> <br /> - 2 - <br /> <br /> <br />
