Section E discusses exemptions from the policy. These include: <br /> (a) when a public official receives a ticket or pass directly from a third party and the <br /> public official performs a ceremonial role or function on behalf of the City at the <br /> event; and <br /> (b) when a public official receives a ticket or pass from the City, and both the public <br /> official and the City report the ticket or pass as income. <br /> Section F includes a prohibition against the transfer of a ticket or pass received by a <br /> public official, unless the transfer is to a member of that public official's immediate <br /> family. This limitation is specifically required by the regulation. <br /> The final provision, Section G, designates the City Manager as the official charged with <br /> the distribution of event tickets and implementation of the Policy. This section also <br /> assigns to the City Clerk the duty of posting the required reporting form (Attachment 2) <br /> on the City's website within 30 days of the distribution of the event ticket. <br /> The following are examples of event tickets, and how they would be regulated by this <br /> proposed Policy and State law: <br /> (a) Tickets to the Fair. If the Alameda County Fair Association gives ten tickets to <br /> the City of Pleasanton for general admission to the Alameda County fair, the City <br /> may accept those tickets. But, under the new regulation, the Fair Association <br /> cannot designate the tickets for use by only certain City officials. (See Section C <br /> of the proposed Policy.) Under this proposed Policy, the City Manager would <br /> determine which City Officials would receive the Fair tickets. After the tickets are <br /> given to the City Officials, disclosure must be posted on the City's website within <br /> 30 days listing: <br /> the event date the value of the tickets <br /> who provided the tickets the number of tickets provided <br /> which officials received the tickets the public purpose underlying the <br /> use of the tickets <br /> (b) Admission to Business Association Event. If a City Official is invited to attend an <br /> event sponsored by a business association (such as the Chamber of Commerce, <br /> Pleasanton Downtown Association, etc.) and serve as a panelist on a panel <br /> featuring Tri- Valley elected officials, then the receipt of the ticket is exempt from <br /> this Policy pursuant to Section E. The City Official is performing a function on <br /> behalf of the City when serving as a panelist representing the City of Pleasanton. <br /> In the case of Fair tickets, the public purposes could include those set forth in Section D 12 and 13 of the proposed <br /> Policy "Attendance at events sponsored by other governmental agencies Increasing public exposure to <br /> venues and facilities available to the public within the City etc. <br /> Page 3 of 4 <br />
