BACKGROUND <br /> The Fair Political Practices Commission (FPPC) is the State agency which adopts, <br /> interprets and enforces laws regarding political campaigns, lobbying, and conflicts of <br /> interest. <br /> The FPPC has adopted a regulation regarding the distribution of event tickets by a <br /> public agency to its officials. (See Title 2 Cal. Code of Regulations §18944.1.) Event <br /> tickets are broadly defined as tickets or passes that allow admission to facilities, events, <br /> shows or performances for entertainment, amusement, recreation or similar purposes. <br /> This regulation applies to event tickets both received by a public agency from a third <br /> party at no cost, as well as event tickets purchased by the public agency. Officials <br /> subject to the regulation include elected and appointed officials, as well as City staff. <br /> The use of event tickets must be for a public purpose, and a designated City official has <br /> to be in charge of the distribution of event tickets. If event tickets are not used for a <br /> specified public purpose, or if an official using an event ticket does not perform a <br /> function on behalf of the agency, then the official receiving the event ticket must report <br /> its value as a gift or as income. <br /> To monitor compliance with the regulation, the FPPC requires that as event tickets are <br /> distributed, each public agency must post on its website information regarding the use <br /> of such tickets. The FPPC has a form to be used for such reporting. (Attachment 2.) <br /> This new regulation also requires that the legislative body of each public agency <br /> formally adopt a written policy to implement these provisions. The proposed Policy <br /> meets these requirements, as discussed below. <br /> DISCUSSION <br /> The first provision, Section A, of the proposed Policy for Distribution of Event Tickets <br /> (Attachment 1) discusses the State law requirements and general policy interest that <br /> event tickets be used for a public purpose, and that such use be publicly disclosed. <br /> Section B defines "ticket "pass "official" and "gift" etc. to track the definitions in State <br /> law. <br /> Section C then states the distribution policy and incorporates the requirements of State <br /> law regarding the specific circumstances when an event ticket may be designated for a <br /> particular official. <br /> Section D lists all of the public purposes for which event tickets may be used. This <br /> language is broadly written to include a variety of local, state, national and international <br /> interests that may serve and promote the City of Pleasanton; and is based on a model <br /> policy presented at a League of California Cities conference that is being used by many <br /> California cities, counties and special districts. <br /> Page 2 of 4 <br />
