1048 <br />Under unfinished *business 'Attorney Nilson advised with regards comperBition <br />insurance mentioning that no requirement was made of municipalities as re ar ds <br />carrying a, reserve* .fund to meet compensation insurance claims. He state that <br />the municipality must be in a position to meet them as they arise and he stated <br />snoe it was carrying insurance then the company withviom the town was insured <br />would pay arty claims presented. According the matter was allowed to rest. <br />Under new business` Councilman Apperson discussed the natter of bringing <br />to the attention of the Southern Pacific Company the necessity of irstallirg a <br />wig -wag at the crossing on Ray Street and he urged immediate action. The matter <br />was referred to Cdr. Garatti who in turn advised that they had been previously <br />approached'some years ago toward having a wig -wag installed and at that time <br />,the Southern Pacific Company refused to install the warning signal contending <br />that it was a private crossing and acco-rdingly,permission to pass over same <br />was revokable at any time. The Council went on record as favoring the renewing <br />of action,as. regards a signal there. <br />Councilman Apperson then took up conditions at the race track. He advised <br />that the fire equipment there together with the sanitary conditions. should <br />be investigated. He mentioned that there were a large number of horses 60� <br />and equally'. arge number of men at the race track and that he thought it would <br />be well for the Fire Chief and Dr. Heinz to look into conditions there. <br />Councilman Lladsen then asked that the Council refer back to "unfinished <br />business" and he brought up the matter of the salary of the Fire'Chief upon <br />which an opinion was to be received from the City Attorney. Attorney Nilson <br />then spoke,in which he told the Council that his attitude on the matter was <br />the same as that at the time I-Ir. Pickard was appointed Fire Chief and that the <br />opinion which he gave at that time stood and that the appointment as made by <br />the Council was upheld under the statutes. He further advised that if I�ir. <br />Tvladsen was not entirely satisfied with this opinion that he could take ~action <br />as he might desire. A <br />The following resolutions were then presented: <br />Resolution No. 1478 -- Authorizing the payment of the salary of the municipal <br />officers for the month of September and amounting X745.00. <br />it it " " 1479 -- Authorizing the payment of �+ 292.13 to the Mad.ewell Ida.nufact- <br />uring Company as the first payment.on an order of surface <br />pipe- amounting to X492.13. <br />" " " if 1480 -- Authorizing the payment of X12.30 to the Madewell I,jianufact- <br />uring Company as Sales tax on the order of surface pipe. <br />" " it it 1481 -- Authorizing the payment of '910.00 to Alva Freeland for <br />the preparing of the list of property owners within the <br />Town of Pleasanton and also the listing of said property <br />owners on tax bills. <br />Action on the resolutions were then taken as follows: <br />Resolution No. 1478-- Adopted,,on motion of Councilman Apperson seconded by, <br />Councilman Orloff and with all presentbq voting in favor <br />of same excepting Councilman Madsen who voted favorably <br />on all except the salary of the Fire Chief, on vnich he <br />voted "No." _ <br />if " " No. 1479 -1480= -Were held up - to the next meeting. <br />No. 1481 - -Was adopted on motion of Councilman Madsen seconded by <br />Councilman Apperson and vdi th all pr esent voting in favor <br />of same. <br />Mayor Pickard as Fire Chief spoke with regards to fires recently held and <br />and an appointment of a man to remain on duty during the night after the fire <br />had been taken placed. He queried the council as to whether the town should <br />pay this ex_-a_ ense or whether . it should be i■s chargedirt the property owner and <br />whether the chief should appoint the man or the property owner. It was decided <br />that the fire chief should appoint the man to remain on duty and for such <br />time as was required -as a safety measure -and that the town should assume the <br />expense• as it had previously. Also it was pointed out that fire hose and,uata{,.,, <br />equipment were generally left on the remises for a i■t time after the <br />fire as a safety measure and according � <br />accordingly the municipality should protect <br />its investment. Councilman Apperson drew attention v iik,,requests from the <br />Fire Chief that two flash lights should be secured and that suitable rain <br />coats were heeded. Te council a ;nprove� of tteses recommendations and it <br />was ordered that the Tire Chief should secure;,two flash lights necessary <br />for his department and also one white rain coat for hin)self and such black <br />rain caatS as were necessary. Ivlr. Apperson further brought to the attention <br />of the council the lack 'of watching fire lines during a fire and the congregating <br />of the townspeople at a fire which often hampered the work of the firemen. He <br />drew attention to the firemen only being in the immediate vicinity of a fire. <br />It was ordered by the council that at fires the necessary help should be <br />procured to keep the townspeople at a 'distance.
