Cost Index for the previous June through July twelve month period <br />and rounded to the nearest dollar. <br /> (b) The City Manager or any affected developer or <br />citizen can submit supplemental information to the City Council <br />and/or the Oversight Committee demonstrating that the fee <br />schedules even as adjusted for inflation no longer accurately <br />reflect the cost of providing classroom space. In that event, <br />Council may review and adjust fees as it deems necessary after <br />notifying interested parties, including affected school districts <br />and developers- <br /> <br />Section 17.28.080 Alternate Methods of Compliance <br /> As an alternative to payment of fees as specified in <br /> Section 17.28,060, the developer can comply with this chapter by <br /> providing equivalent value in lieu of fees. The Council shall <br /> determine what constitutes equivalent value after consultation <br /> with the affected school district. Equivalent value in lieu of <br /> fees may include: <br /> <br /> (a) Dedication of land. <br /> <br /> (b) Construction of buildings or other improvements. <br /> <br /> (c) Consideration agreed upon by the parties to a long <br /> Term Agreement granted pursuant to the City's Growth Management <br /> Program. <br /> (d) Inclusion of the land or subdivision being proposed <br /> for development in a Mello-Roos Public Facilities Assessment <br /> District- <br /> (e) Any other method of compliance which the City <br /> Council finds consistent with the spirit and purpose of this <br /> chapter, <br /> Section 17.28,090 Establishment of Separate Accounts for Each <br /> School District <br /> (a) The Director of Finance shall establish a separate <br /> account for each school district for which there is an approved <br /> finding of overcrowding. <br /> (b) Any fees or funds which the City receives as a <br /> result of the approved findings of overcrowding for a given <br /> school district shall be placed in the account established for <br /> the benefit of that school district. <br /> (c) Any interest received on funds in each separate <br /> account shall accrue to that account. <br /> (d) The school districts and City Council can agree as <br /> part of an approved school expansion plan for transfer of fees <br /> received for the account of a contributing school district to <br /> accomplish a necessary school expansion in a recipient school <br /> <br /> - 6 - <br /> <br /> <br />
