Implementation Regulations <br /> Growth Limitation Plan <br /> 3. Housing in Close Proximity to BART (density bonus units) <br /> Density bonus units (25 of a residential project located within <br /> approximately 1,500 feet of a BART station are exempt from the roadway <br /> level of service standards and the traffic weighted point system. Market <br /> rate units within the project must comply with growth limitation <br /> regulations. All units are deducted from the residential development cap. <br /> IX. COMMUNITY FACILITIES (Public Benefit Projects) <br /> Community Facilities are exempt from the roadway level of service standards, the traffic <br /> weighted point system, and the commercial or residential development caps. Community <br /> Facilities include: <br /> a. Adult Day Care Facilities (7 or more) <br /> b. Child Day Care Facilities (7 or more) <br /> c. Colleges, Public or Private <br /> d. Cultural Institutions (includes libraries, museums, etc.) <br /> e. Government Offices <br /> f. Hospitals (includes emergency medical care) <br /> g. Housing for the Homeless (includes emergency shelters, transitional housing) <br /> h. Maintenance and Service Facilities <br /> i. Park and Recreation Facilities <br /> j. Public Parking Facilities <br /> k. Public Safety Facilities <br /> 1. Public Transit Terminals <br /> m. Recycling Facilities <br /> n. Religious Assembly <br /> o. Residential Care Facilities (7 or more) <br /> p. Schools, Public or Private <br /> q. Skilled Nursing Facilities <br /> r. Utilities, Major and Minor <br /> When a Community Facility organization purchases an existing commercial building, the <br /> commercial square footage used by the Community Facility will be returned to the <br /> commercial allocation pool, upon termination of the commercial use, if the property is <br /> owned and operated by the Community Facility organization for the Community Facility <br /> use. A return of square footage to the commercial allocation pool is not permitted if a <br /> Community Facility organization is leasing space from another property owner. <br /> X. REGULATION INTERPRETATION <br /> It is recognized that in developing these regulations not all situations pertaining to growth <br /> limitation could be anticipated.
