Implementation Regulations <br /> Growth Limitation Plan <br /> project applications shall be processed under the General Plan and growth man- <br /> agement regulations in effect on the date the application was deemed complete <br /> unless the applicant makes a written request to process under the new regulations <br /> in effect after September 1, 1993. <br /> B. Projects which have received all discretionary approvals from the City on or <br /> before September 1, 1993. Projects may receive a one year extension for Design <br /> Review approval, and still be exempt, provided that the applicants for the projects <br /> have made a good faith effort to proceed through the building permit process. <br /> C. Projects for which the City and the owner have entered into a Development <br /> Agreement prior to September 1, 1993. <br /> VIII. PROJECT EXEMPTIONS <br /> The following projects are exempt from the roadway level of service standards and the <br /> traffic weighted point system. Net new development will be deducted from the <br /> development caps. All standard application procedures, including environmental review, <br /> apply to these projects. <br /> A. Replacement of Existing Development <br /> When a structure is demolished (after January 1990) and the site is redeveloped, <br /> the applicant is given credit for the same amount of square footage or number of <br /> dwelling units that existed on the site prior to demolition. <br /> If the replacement structure is smaller than the original structure, the "excess" <br /> amount of square footage shall be credited to the commercial allocation pool, <br /> unless it can be demonstrated that the excess square footage is likely to be used on <br /> the same site in the near term. In such a case, the Planning Manager may apply a <br /> credit to the site for future development, provided that the total amount of <br /> development on the site complies with property development standards, including <br /> floor area ratios. <br /> When the land use is amended, or when the existing structures are very small, <br /> (i.e., a gas station or outdoor sales) it may be appropriate to give credit for the <br /> number of P.M. peak hour trips that were generated by the former use rather than <br /> credit for the amount of square footage or the number of dwelling units that <br /> existed on the site prior to demolition. The peak hour trips would be converted to <br /> an equivalent building size according to the proposed use. Only net new square <br /> footage or dwelling units would be subject to the provisions of these regulations. <br /> B. Destroyed Structures <br /> A structure that was destroyed through no fault of the owner or one acting on <br /> 11 <br />
