Implementation Regulations <br /> Growth Limitation Plan <br /> 2. Land Use Changes <br /> In addition to State law and City requirements for processing land use <br /> changes, applications for General Plan Amendments or Rezonings will be <br /> processed as follows: <br /> If the request is for a land use change only, and is not accompanied by a <br /> request for net new development, the growth limitation regulations do not <br /> apply. <br /> If the request is for a land use change, and includes net new development, <br /> then the applicant may request an allocation reservation when the <br /> application is deemed complete by the Planning Division, as described <br /> above. Net new development will be deducted from the development caps <br /> upon issuance of a building permit. <br /> When a residential use is replaced by a non residential use, the dwelling <br /> units lost by the conversion will be added back into the residential <br /> development cap. No credit will be given to the new project for the <br /> number of P.M. peak hour trips generated by the residential use prior to <br /> conversion. <br /> When a commercial use is replaced by a residential use, the commercial <br /> square footage is eliminated and not credited back into the commercial <br /> development cap. The P.M. peak hour trips generated by the commercial <br /> use prior to conversion (existing on the site as of January 1990) will be <br /> credited toward the new project. <br /> 3. Conditional Use Permits <br /> In addition to normal processing requirements, applications for <br /> Conditional Use Permits, except for Community Facilities, will be <br /> processed as follows: <br /> If the request is for a conditionally permitted land use only, and is not <br /> accompanied by a request for net new development, the growth limitation <br /> regulations do not apply. <br /> If the request is for a conditionally permitted land use, and includes a <br /> request for net new development, the applicant may request an allocation <br /> reservation when the application is deemed complete by the Planning <br /> Division, as described above. <br /> 8 <br />
