The Chief Building Official shall have the power to grant a <br />variance to any of the provisions of the adopted Uniform <br />Mechanical Code upon application, in writing, by the <br />affected party or his duly authorized agent, when there are <br />practical difficulties in the way of carrying out the strict <br />letter of the code; provided, that the spirit of the code shall <br />be observed, public health, safety and welfare secured and <br />substantial justice done. The particulars of such variance <br />and the decision of the Chief Building Official shall be <br />entered in the records of the Public Works Department of <br />the City and a signed copy furnished the applicant. The <br />granting of any variance shall not be construed to imply or <br />fix any liability on the part of the City or any officer or <br />employee thereof for any damages to persons or property <br />by reason of such variances. <br /> <br />Section 20.16.060 Section 110.1 Amended - Appeals <br /> <br />Section 108.1 of the California Building Standards Code 2001 Edition, (24 <br /> C.C.R.), and including by reference the Uniform Mechanical <br /> Code, 2000 Edition is amended as follows: <br /> <br />110.1 Appeals: Whenever the Chief Building Official shall <br />disapprove an application or refuse to grant a permit <br />applied for, or when it is claimed that the provisions of the <br />code or this Chapter do not apply or that the true intent or <br />meaning of the code has been misconstrued or wrongly <br />interpreted, the applicant may appeal from the decision of <br />the Chief Building Official to the City Manager within <br />thirty (30) days from the date of the decision appealed. <br />Such appeal shall be in writing and the City Manager shall <br />within thirty (30) days of the receipt of the appeal and by <br />written notice to the appellant either uphold, reverse or <br />modify the decision of the Chief Building Official. The <br />decision of the City Manager may be appealed within thirty <br />(30) days of said decision to the Board of Appeals <br />established by Section 20.16.070 of this Chapter. <br /> <br />Section 20.16.070 Board Of Appeals - Established: <br /> <br />There is created and established a Board of Appeals <br />consisting of five (5) members. Each member of the Board <br />of Appeals shall be appointed by the Council for a term of <br />two (2) years; provided, that the first two (2) members <br /> 54 <br /> <br /> <br />
