Section 20.12.070 Appeals: <br /> <br />Whenever the Chief Building Official shall disapprove an <br />application or refuse to grant a permit applied for, or when <br />it is claimed that the provisions of the code or this Chapter <br />do not apply or that the true intent or meaning of the code <br />has been misconstrued or wrongly interpreted, the applicant <br />may appeal from the decision of the Chief Building Official <br />to the City Manager within thirty (30) days from the date of <br />the decision appealed. Such appeal shall be in writing and <br />the City Manager shall within thirty (30) days of the receipt <br />of the appeal and by written notice to the appellant either <br />uphold, reverse or modify the decision of the Chief <br />Building Official. The decision of the City Manager may be <br />appealed within thirty (30) days of said decision to the <br />Board of Appeals established by Section 20.12.080 of this <br />Chapter. <br /> <br />Section 20.12.080 Board Of Appeals - Established: <br /> <br />There is created and established a Board of Appeals <br />consisting of five (5) members. Each member of the Board <br />of Appeals shall be appointed by the Council for a term of <br />two (2) years; provided, that the first two (2) members <br />appointed shall serve a term of one year. The Board shall <br />elect a chairman. The Director of Public Works or his <br />representative shall be an ex officio member of said Board <br />and shall serve as secretary. The Board shall adopt <br />reasonable rules and regulations for conducting its <br />business. Any board of appeals appointed by the City <br />Council under the provisions of any other ordinance may <br />act as the Board of Appeals provided for in this Chapter <br />when so directed by resolution of the City Council. <br /> <br />Section 20.12.100 Notification: <br /> <br />A notice given by the Board of Appeals shall be served <br />personally or be sent by registered or certified mail, postage <br />prepaid, return receipt requested, to the person owning the <br />land on which the building or structure is located, as such <br />person's name and ad&ess appears on the last equalized <br />assessment roll, and to a mortgagee or beneficiary under <br />any deed of trust of record, at the last known address of <br />such mortgagee or beneficiary; provided, that if the <br />49 <br /> <br /> <br />
