development plan, the developer shall enter into an <br /> agreement which, in the view of the City Attorney, <br /> appropriately protects the City from landslide and <br /> subsidence claims which may arise as a result of <br /> building this project on a hillside location. <br /> <br />4. That the developer generate additional hydraulic <br /> calculations for the Arroyo de la Laguna in order to <br /> determine the exact amount of right-of-way and/or <br /> improvements that will be necessary in order to satisfy <br /> the requirements of the Alameda County Flood Control and <br /> Water Conservation District - Zone 7 requirements. If <br /> at the time of the final analysis of the channel it is <br /> determined that additional improvements are needed, then <br /> the applicant shall be responsible for an appropriate <br /> portion of these future improvements as determined by <br /> staff and Zone 7. <br /> <br /> 5. That the final drainage plan shall address the need to <br /> provide natural seasonal flows of water through the <br /> existing drainage channels that are to be retained in <br /> order to provide water to the dense vegetation lining <br /> these drainages. In addition, channelized flows shall <br /> be engineered as to minimize any downslope flooding <br /> problems. <br /> <br /> 6. That the buildings in the development shall be a maximum <br /> of two stories in height not to exceed 35 ft. <br /> <br /> 7. That the final grading plan shall include details on the <br /> methods by which mud flows potentially originating in <br /> the Augustine Bernal Park shall be controlled, and, if <br /> such methods are deemed unacceptable by the City, <br /> affected lots shall be eliminated from the project. <br /> <br /> 8. That the final development plan shall include an overall <br /> fencing plan for the project, including typical design <br /> for the townhome developments and any fencing proposed <br /> within any common areas. Typical locations and designs <br /> of fencing for the individual custom lots shall be <br /> included. These details shall remain on file in the <br /> Planning Department for use as a reference. All <br /> proposed fencing on the project site shall be subject to <br /> approval by the Planning Department. <br /> <br /> 9. That the final development plan shall include <br /> preliminary design plans for all townhomes proposed on <br /> the site. All proposed structures must blend with their <br /> surroundings to the maximum extent practicable. <br /> Building materials shall be confined to varying types of <br /> wood and some types of masonry (such as slumpblock or <br /> brown brick). Colors shall be those earthtones which <br /> best conform to the area. Bright obtrusive colors, such <br /> as white, and light gray walls or red/blue roofs shall <br /> be prohibited. <br /> <br /> <br />
