Conditions of Approval - PUD-85-15 <br /> <br /> 1. That the final development plan be substantially as <br /> shown on the revised preliminary development plan, <br /> Exhibit A, on file with the Planning Department, and as <br /> modified herein. The final development plan shall <br /> reflect all of the following conditions and include any <br /> adjustments that must be made to the preliminary <br /> development plans a result of additional study. <br /> <br /> a. That, if the City so chooses following further study <br /> by the Park and Recreation Commission, Planning <br /> Commission and City Council, the project shall <br /> incorporate a public access road and staging area <br /> into the final development plan in a manner so <br /> determined following such study, the intent being to <br /> provide such access/staging area in a manner which <br /> will have minimal interference on the approved <br /> development plan and which provides access only to <br /> the City's Bernal Park (not a future EBRPD ridgeland <br /> park). <br /> <br /> b. That the common open areas and areas outside planned <br /> grading within custom lots occupying the "bench" <br /> areas be planted in random growth patterns with 5 <br /> and 15 gallon trees (native species) with a support <br /> drip/bubbler irrigation system at the time the first <br /> final map is approved for a portion of the project; <br /> that after grading, similar random plantings occur <br /> along streets and within lots in a pattern to be <br /> approved at the time of any tentative map including <br /> streets within the "bench" areas; and that Lots 22 <br /> and 23, 26, 52-60, and 63-70 be the last lots in the <br /> project subdivided and offered for sale. <br /> <br />2. That because of the preliminary nature of the project <br /> development plan, final landscape, grading, drainage, <br /> site, fencing, and any other additional information <br /> referenced in the following conditions shall be <br /> submitted at the time of the final development plan <br /> approval for the project. The final development plan <br /> submittal shall reflect the appropriate applicable <br /> mitigation measures detailed in the Draft EIR for the <br /> project. <br /> <br /> 3. That the Homeowner's Association shall enter into an <br /> agreement to hold harmless, defend and indemnify the <br /> City, its officers and employees from any cause of <br /> action or claim for damage or injury caused by the <br /> private roadways, or private utility systems, or their <br /> maintenance and upkeep, or caused by the party <br /> contracted with for maintenance services and that the <br /> CC&R's shall make each homeowner chargeable for costs <br /> related to responsibilities provided for in this <br /> condition; and that prior to approval of the final <br /> <br /> EXHIBIT C <br /> <br /> <br />
