BACKGROUND <br /> In the late 1980's, the City approved three subdivisions that made up the Golden Eagle <br /> development. The development is located on both sides of Foothill Road between <br /> Longview Drive to the north and Oak Manor Court to the south. Part of the subdivision <br /> improvements included the widening of Foothill Road along the project frontage to <br /> accommodate bike lanes and turning lanes. In addition to the street widening, street <br /> lights were installed along the east side of the project's Foothill Road frontage. After the <br /> street lights were installed, some of the existing neighbors to the south of the Golden <br /> Eagle development complained that the street lights were not in character with the rural <br /> nature of this portion of Foothill Road. Council directed staff to have the street lights <br /> along Foothill Road removed (18) except at the intersections of Golden Eagle Way and <br /> Longview Drive (3). <br /> In April of this year, the City was approached by representatives of the Golden Eagle <br /> Luxury Homeowners' Association about installing street lights on the east side of <br /> Foothill Road across the frontage of their development and presented a petition signed <br /> by 162 residents that were in favor of reinstalling the streets lights on Foothill Road <br /> along the Golden Eagle frontage. <br /> At the City Council meeting of April 7, 2009, staff presented a staff report <br /> recommending that the 18 street lights along the Golden Eagle development be <br /> reinstalled. Two of the neighbors at south end of the development spoke out against the <br /> lights, as they felt the lights were not needed in that section of Foothill Road. Council <br /> approved staff's recommendation, with the exception of the last three street lights on the <br /> south end of the development and directed staff to work with the residents to determine <br /> if there could be a compromise on these last three lights. City Council also directed <br /> staff to consider the use of LED lighting as an alternative light source along this corridor. <br /> Staff has consulted with the two gentlemen who spoke out against the street lights and <br /> was not able to work out a compromise on these last three street lights. Since that time, <br /> many other neighbors whose houses are also located near the south end of the Golden <br /> Eagle Development have approached staff about the Council decision not to install <br /> these last three street lights. At the May 19, 2009 City Council meeting during "Public <br /> Comment," several residents that live on the south end of the Golden Eagle <br /> Development spoke asking the Council to reconsider its motion not to reinstall the last <br /> three street lights on Foothill Road, as they believed the Council did not have all the <br /> facts before making its previous decision. At that same meeting during "Matters Initiated <br /> by Council," the Council indicated that it was its intent that staff work with the two <br /> dissenting residents to reach an equitable agreement on the three southerly street <br /> lights. Staff confirmed that a solution had not been reached that satisfied the residents <br /> and the only remaining option was to forego the installation of the last three lights. City <br /> Council asked that staff provide additional information with regards to the accident <br /> history along this reach, as well as the distances between the proposed lighting and <br /> existing homes. Council then voted to bring this matter back to City Council with the <br /> additional information for further consideration. <br /> Page 2 of 5 <br />
