That the applicant shall remove the existing 36" diameter <br /> eucalyptus tree from the site unless the adjacent property <br /> owners to the south, who shall be contacted prior to removal, <br /> request its retention. <br /> <br /> 22. That the nonfunctional spandrel panels that run between the <br /> support columns of the canopy structure be eliminated. <br /> <br /> 23. That the arched spandrel panels proposed on the retail <br /> structure be increased to at least 18" in width in order to <br /> create a usable future sign panel. The final design of the <br /> spandrel shall be submitted for review and approval by the <br /> Planning Director prior to issuance of any building permits. <br /> <br />24. That a projecting soldier course of bricks be included across <br /> the top of 'all brick walls of the retail structure. The <br /> final design of this soldier course feature shall be <br /> submitted for review and approval of the Planning Director <br /> prior to issuance of any building permits. <br /> <br />25. That the developer enter into an agreement with the City to <br /> enter into an assessment district or districts for the <br /> construction of all the facilities necessary for the <br /> amelioration of traffic congestion caused by development of <br /> the subject property. These facilities may be those <br /> discussed in the North Pleasanton Traffic Studies~ or other <br /> facilities deemed necessary by the City. The agreement shall <br /> be entered into prior to the issuance of a building permit <br /> unless this condition has already been met. <br /> <br />26. That prior to issuance of a building permit on the subject <br /> property, the developer shall fund (or participate in the <br /> funding of) a comprehensive water study of the north <br /> Pleasanton area to identify short and long-term improvements <br /> necessary to achieve adequate water supply and pressure. In <br /> order to achieve timely completion of such improvements <br /> concurrent with the development of the subject site, the <br /> developer shall enter into an agreement to pay his <br /> appropriate share of the cost of the water facilities <br /> necessary to serve the subject property or made necessary due <br /> to the cumulative development of the north Pleasanton area. <br /> Improvements may be made via reimbursement agreement, <br /> assessment districts or benefit districts as best meet the <br /> needs of the City and the developer.
