8. That all recommendations of the tree study prepared <br /> by Hort Science, Inc. dated, November 7, 1986 be <br /> incorporated as conditions of approval except where <br /> modified by the Planning Director and applicant to <br /> preserve some of those trees with marginal health <br /> problems. <br /> <br /> 9~ That the applicant complete all necessary bank <br /> stabilization work along the Arroyo del Valle as <br /> required by Zone 7. <br /> <br />10. That the applicant shall dedicate an approximately <br /> 1.8 acre portion of the site to Zone 7 and grant an <br /> access easement to Zone 7 through the proposed 20 <br /> ft. wide on-site access driveway. <br /> <br />11. That this development plan shall be contingent upo~ <br /> the City's acceptance of a recreation easement from <br /> Zone 7 over the portion of the site dedicated to <br /> Zone 7 and shall be subject to any conditions which <br /> may be attached therein. <br /> <br />12. That the developer shall enter into an agreement to <br /> hold the City harmless if any improvements are made <br /> to property (passive open space area) located <br /> within the areas of the future recreation easement. <br /> <br />13. That construction pursuant to a valid building <br /> permit shall commence with one year. Failure to do <br /> so will result in the expiration of the development <br /> plan approval. <br /> <br /> 14. The on-site storm drainage, water, and sanitary <br /> sewer systems for this development shall be private <br /> systems and shall be maintained by the property <br /> owner(s). The existing storm drain which conveys <br /> storm drainage from Division Street across the site <br /> to the channel shall be a public system maintained <br /> by the City. This line shall be redesigned, <br /> relocated, and be installed to the satisfaction of <br /> the City Engineer. A 15' wide P.S.E. over this <br /> storm drain line shall be granted to the City. <br /> Vehicle access shall be required to all manholes <br /> and inlets on this line. <br /> <br /> <br />
