II. <br /> <br />Term. The term of this Development Agreement shall commence upon the date <br />of execution and shall continue in full force and effect for ten (103 years <br />thereafter. <br /> <br />III. <br /> <br /> Dedication of Right-o f-Way and Easements. <br /> <br />A. Property Owner a~ees to dedicate the following interests in real property <br /> as shown in Exhibit B: <br /> (1) Roadway right-of-way for the construction of the realigned <br /> Vineyard Avenue: <br /> <br /> (2) Temporary construction easements around the above-described <br /> <br /> lands as shown on Exhibit B, to last until the improvements have <br /> been accepted by the City. <br /> <br />B. All rights-of-way and easements shall be ~anted within 15 days of <br /> Property Owner's receipt of request for same by the City's Director of <br /> Public Works, who is hereby empowered to accept and record such grants. <br />C. The Director of Public Works shall request the dedications only in the <br /> event: <br /> <br /> ( 1 ) PG&E gives notice to the City that it intends to build its 230KV <br /> transmission line in the realigned Vineyard Avenue and is moving <br /> forward with construction; and <br /> <br />Revision 433.~_-, Draft Hahner Development Agreement Page 7 of '~: !
